This chapter shall be known and may be cited
as the "Walk-a-thon/Bike-a-thon Ordinance of the Township of Harding."
As used in this chapter, the following terms
shall have the meanings indicated:
PERSON
Any person, firm, partnership, association, corporation,
company or organization of any kind.
WALK-A-THON/BIKE-A-THON
Any procession on foot or by bike consisting of a minimum
of 25 persons in or upon any street, park or other public place in
the Township.
A person seeking issuance of a walk-a-thon/bike-a-thon
permit shall file an application with the Chief of Police on forms
provided by such officer. An application for a permit shall be filed
with the Chief of Police not less than 10 days nor more than 60 days
before the date on which it is proposed to conduct the walk-a-thon/bike-a-thon.
The Chief of Police shall issue a permit as
provided for hereunder when, from a consideration of the application
and from such other information as may otherwise be obtained, he finds
that:
A. The conduct of the proposed activities will not substantially
interrupt the safe and orderly movement of other traffic contiguous
to its route.
B. The conduct of the proposed activities will not require
the diversion of so great a number of police officers of the Township
to properly police the line of movement and the areas contiguous thereto
as to prevent normal police protection to the Township.
C. The conduct of the proposed activities will not require
the diversion of ambulance service to portions of the Township, other
than that to be occupied by the proposed line of march and areas contiguous
thereto.
D. The concentration of persons and vehicles at assembly
points will not unduly interfere with proper fire and police protection
of, or ambulance service to, areas contiguous to such assembly areas.
E. The conduct of the proposed activities will not interfere
with the movement of fire-fighting equipment en route to a fire.
F. The conduct of the proposed activities are not reasonably
likely to cause injury to persons or property, to provoke disorderly
conduct, create a disturbance or create litter.
G. The proposed activities are scheduled to move from
point of origin to point of termination expeditiously and without
unreasonable delays en route.
H. The proposed activities are not to be held for the
sole purpose of advertising any product, goods or event, and are not
designed to be held purely for private profit.
Any person aggrieved shall have the right to
appeal the denial of a walk-a-thon/bike-a-thon permit to the Township.
The appeal shall be taken within 10 days after notice. The Township
Committee shall act upon the appeal within 20 days after its receipt.
The Chief of Police, in denying a request for
a walk-a-thon/bike-a-thon permit, shall be empowered to authorize
the conduct of the proposed activities on a date, at a time or over
a route different from that proposal.
The Chief of Police shall have the authority
to revoke a walk-a-thon/bike-a-thon permit issued hereunder upon application
of the standards for issuance as herein set forth.

Each person requesting a permit shall pay a fee as provided in Chapter
171, Fees, to Harding Township, except that no fee shall be charged to a person applying on behalf of an eleemosynary or nonprofit organization.
Any person violating any provision of this chapter shall be subject to the general penalty provided in Chapter
1, Article
I, of this Code.
