This chapter shall be known as the "Returned Check Ordinance."
Whenever a check or other written instrument payable to any account
of the Township of Hillsborough is not honored by the drawee because the issuer
of the check had no account with the drawee at the time the check was issued
or because of insufficient funds, a service charge of $20 per check or other
written instrument shall be added to the account or accounts upon which payment
was attempted. The service charge shall be paid and credited before any other
payment on the account is accepted and credited.
Unpaid service charges shall, when assessed with respect to the attempted
payment of a tax or special assessment, be a lien against property, to be
enforced in the same manner as other liens.
Any person who becomes liable for a service charge under this chapter
on a chronic basis may, as determined by the governing body with the recommendation
of the Chief Financial Officer, thereafter be required to pay in cash or by
certified or cashier's check.
