For the purposes of this article, the following
terms shall have the meanings indicated:
GOVERNMENT BUILDINGS
A building or portion of a building owned or leased by a
government entity, exclusive of school, college, university and professional
training buildings and health care facilities. Facilities owned or
leased by a government entity and used for the holding of sports events,
such as football, baseball, basketball and horse racing, or providing
ambulatory recreation, such as ice and roller skating, are excluded
from this definition.
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other
matter or substance which contains tobacco.
It is the purpose of this article to prohibit
smoking in government buildings so as to comply with the Public Employees
Occupational Safety and Health Act Construction Code as provided in
N.J.A.C. 5:23-11.

Smoking or the use of electronic smoking devices
is prohibited in all areas of government buildings, on any Township
property located within 500 feet of any elementary or secondary educational
institution and all outdoor public parks and recreational areas that
are owned, leased or used by the Township.
Every public entrance to government buildings
shall be posted with a sign indicating that smoking is prohibited
everywhere in the building. Such sign shall be erected by the Township.
The sign may indicate that the violators are subject to a fine.

Any person who smokes in government buildings or in any of the other prohibited locations indicated in §
257-7 is in violation of this article and is subject to a fine not to exceed $100.
