Any person who, with intent to provoke a breach of the peace or whereby
a breach of the peace may be occasioned, commits any of the following acts
shall be deemed to have committed the offense of disorderly conduct:
A. Uses offensive language, conduct, behavior. Uses or indulges
in offensive, disorderly, threatening, abusive or insulting language, conduct
or behavior.
B. Annoys, disturbs others. Acts in such manner as to annoy,
disturb, interfere with, obstruct or be offensive to others.
C. Unlawful assembly. Congregates with others on a public
street, sidewalk, park or place and refuses to move on when ordered by the
police.
D. Causes crowd to collect. By his or her actions causes
a crowd to collect, except when lawfully addressing such a crowd.
E. Shouts, makes noise. Shouts or makes any other noise
outside or inside a building during the nighttime to the annoyance or disturbance
of any considerable number of persons.
F. Interferes with others. Interferes with any person in
any place by jostling against such person or unnecessarily crowding him or
her or by placing a hand in the proximity of such person's pocket, pocketbook
or handbag.
G. Solicits alms. Stations himself or herself on the public
streets or follows pedestrians for the purpose of soliciting alms or who solicits
alms on the public streets, unlawfully.
H. Lewd conduct. Frequents or loiters about any public place
soliciting persons of the same or opposite sex for the purpose of committing
a crime against nature or other lewdness.
I. Disturbances in public conveyances. Causes a disturbance
in any railroad car, omnibus or other public conveyance by running through
it, climbing through windows or upon the seats or otherwise annoying passengers
or employees therein.
J. Annoys pedestrians. Stands on sidewalks or street corner
and makes insulting remarks to or about passing pedestrians or annoys such
pedestrians.
K. Criminal activities. Is engaged in any illegal occupation or who bears an evil reputation and with an unlawful purpose consorts with thieves and criminals or frequents unlawful resorts. In any prosecution under this Subsection
K, the fact that the defendant is engaged in an illegal occupation or bears an evil reputation and is found consorting with persons of like evil reputation, thieves or criminals shall be prima facie evidence that such consorting was for an unlawful purpose.
L. Unlawful use of municipal property. Makes use of any
municipal property, including parks or stadiums, or conducts himself or herself
in a manner contrary to any posted notices, rules or regulations of the village
or who refuses to obey the orders of any person or persons in authority with
respect to the use of or conduct in or with respect to such property.
M. Indecent dress. Being a person over the age of 16 years
and who appears in the Business District or any other public street or place
within the village dressed in such manner which fails to conceal that portion
of the wearer's body extending from the shoulders to a point midway between
the hips and knees.
N. Violates ordinance. Violates any ordinance herein which
by its terms declares such violation to be disorderly conduct.
Prohibited in designated places. Spitting upon the sidewalk or crosswalk
of any public street, avenue, park, public square or place in the village
or upon the floor of any apartment or other home which is used in common by
the tenants thereof or upon the floor of any hall or lodging house which is
used in common by the guests thereof or upon the floor of any theater, schoolhouse,
church, store, factory or any building which is used in common by the public
or upon the floor of any railroad car or other public conveyance or upon the
station platform of any railroad or other common carrier is hereby forbidden.
Any person violating any provision of this chapter shall be liable to a penalty set in accordance with Chapter
1, Article
III, General Penalty.
