A. 
Pursuant to the provisions of Article 7 of the Village Law of the State of New York, the Planning Board of the Village of Chester, Orange County, New York, hereby appointed,[1] shall have full power and authority to prepare a Master Plan, to make such investigations, maps and reports and recommendations in connection therewith relating to the planning and the development of the Village as it seems desirable, to report upon matters referred to it by the Village Board of Trustees or as required by Article 6-A, as amended, and shall have the authority to employ experts and to pay for their services and such other expenses as may be necessary and proper, provided that the total expenditures shall not exceed the appropriations of said Board for its expenses.

B. 
Pursuant to, and in accordance with, §§ 7-728 and 7-730, as from time to time amended, of the Village Law of the State of New York, the Planning Board of the Village of Chester, Orange County, New York, hereby appointed, is hereby authorized and empowered to approve preliminary and final plats of subdivisions, including the use of cluster development, showing lots, blocks or sites with or without streets or highways in the Village of Chester, Orange County, New York.

C. 
Pursuant to, and in accordance with, § 7-738, as amended, of the Village Law of the State of New York, the Planning Board of the Village of Chester, Orange County, New York, is hereby authorized, simultaneously with the approval of any plat, either to conform to the zoning regulations of the land so platted as shown on the Zoning Map of the Village of Chester[2] or to make any reasonable change therein.

D. 
Pursuant to, and in accordance with, the provisions of § 7-725-a of the Village Law of the State of New York, the Planning Board of the Village of Chester, Orange County, New York, hereby appointed, is hereby authorized and empowered to approve site plans.
E. 
Pursuant to, and in accordance with, the provisions of § 7-725-b of the Village Law of the State of New York, the Planning Board of the Village of Chester, Orange County, New York, hereby appointed, is hereby authorized and empowered to grant special use permits.
The Clerk of the Village of Chester, Orange County, New York, is directed to forthwith file with the Clerk of the County of Orange a certificate showing that the Village Board of the Village of Chester, Orange County, New York, has authorized its Planning Board to approve plats showing new streets or highways within the Village of Chester, Orange County, New York, pursuant to the provisions of § 7-728 of the Village Law of the State of New York, and said Clerk is requested to write to the County Clerk of Orange County and request such Clerk, pursuant to the provisions of § 7-728 of the Village Law of the State of New York, to refuse to file or record in his office any plat of a subdivision of land showing a new street or highway until it has approval by the Planning Board of the Village of Chester, Orange County, New York.

A. 
Members. The Planning Board of the Village of Chester shall consist of five members. Members and the Chairperson of such Planning Board shall be appointed by the Mayor, subject to the approval of the Board of Trustees. In the absence of a Chairperson, the Planning Board may designate a member to serve as Chairperson. Compensation of Planning Board members shall be as provided in resolutions passed, from time to time, by the Village Board of Trustees. The term of each member shall be five years, with one such term expiring each year. If a vacancy shall occur otherwise than by expiration of term, it shall be filled by the Mayor, with the approval of the Village Board, by appointment for the unexpired term. All provisions of Village Law § 7-718 relating to planning board member and chairman duties, training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal, and service on other boards, shall apply to the members.
B. 
Alternates.
(1) 
Up to three alternate members of the Planning Board shall be appointed by the Mayor, subject to the approval of the Board of Trustees, for terms of three years, with one such term expiring each year.
(2) 
The Chairperson of the Planning Board may designate an alternate member to substitute for a member when such member is unable to participate on an application or matter before the Board. When so designated, the alternate member shall possess all the powers and responsibilities of such member of the Board. Such designation shall be entered into the minutes of the initial Planning Board meeting at which the substitution is made.
(3) 
All provisions of Village Law § 7-718 relating to planning board member training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal, and service on other boards, shall also apply to alternate members.
