The purpose of this chapter is to authorize, pursuant to the authority of the New York State Constitution, Article 1, § 9, and General Municipal Law Article 9-A, the conducting by an authorized organization, upon obtaining a license therefor, of games of chance within the territorial limits of the Town of Sweden, subject to the provisions of this chapter, the provisions of General Municipal Law Article 9-A, and the provisions set forth by the New York State Racing and Wagering Board.
It shall be lawful for any authorized organization, upon obtaining a license therefor as provided by Article 9-A of the General Municipal Law, to conduct games of chance within the territorial limits of the Town of Sweden, subject to the provisions of this chapter, the provisions of Article 9-A of the General Municipal Law and the provisions of the New York State Racing and Wagering Board.

Games of chance shall be conducted in accordance with the procedures and requirements of § 189 of the General Municipal Law.[1]

A. 
The unauthorized conduct of a game of chance shall constitute and be punishable as a misdemeanor, subject to a fine of not less than $100 nor more than $1,000 or imprisonment for not more than one year, or both.

B. 
This chapter shall not become operative and effective unless and until it shall have been approved by a majority of the electors voting on a proposition submitted at a general or special election held within the Town of Sweden who are qualified to vote for the officers of such municipality.[1]
