Whitpain Township hereby elects to administer
and enforce the provisions of the Pennsylvania Construction Code Act,
Act 45 of 1999, 35 P.S. § 7210.101 through 7210.1103, as
amended from time to time, and its regulations.
The Uniform Construction Code, contained in
34 Pa. Code, Chapters 401 through 405, as amended from time to time,
is hereby adopted and incorporated herein by reference as the Building
Code of Whitpain Township.
In addition to the Uniform Construction Code
as contained in 34 Pa Code, Chapters 401 through 405, being adopted
as the Building Code of Whitpain Township, the following Appendices
are incorporated in and shall become a part of the Building Code of
Whitpain Township:
A. Appendix A - 2003 International Building Code (Appendix
A).
B. Appendix B - 2003 International Residential Code (Appendix
A, B, C, G and L).
C. Appendix C - 2003 International Fuel and Gas Code
(Appendix A, B and C).
D. Appendix C - 2003 International Plumbing Code (Appendix
B, D, E and F).
E. Appendix D - 2003 International Mechanical Code (Appendix
A).
F. Appendix E - 2003 International Energy Conservation
Code (Appendix).
G. Appendix F - 2003 International Performance Code (Appendix
A, B, C, D and E).
H. Appendix G - 2003 International Existing Building
Code (Appendix Resource A).
I. Appendix H - 2003 International Urban - Wildland Interface
Code (Appendix A, B, C, D E, F, G and H).
Administration and enforcement of the Uniform
Construction Code within Whitpain Township shall be undertaken in
any of the following ways as determined by the Board of Supervisors
of Whitpain Township from time to time by resolution:
A. By the designation of an employee of the Whitpain
Township to serve as the Whitpain Township code official to act on
behalf of the Whitpain Township.
B. By the retention of one or more construction code
officials or third-party agencies to act on behalf of Whitpain Township.
C. By agreement with one or more other municipalities
for the joint administration and enforcement of this Act through an
inter-municipal agreement.
D. By entering into a contract with another municipality
for the administration and enforcement of this Act on behalf of Whitpain
Township.
E. By entering into an agreement with the Pennsylvania
Department of Labor and Industry for plan reviews, inspections and
enforcement of structures other than one-family or two-family dwelling
units and utility and miscellaneous use structures.
A Board of Appeals shall be established by resolution
of the Board of Supervisors of Whitpain Township in conformity with
the requirements of the code, as amended from time to time, and for
the purposes set forth therein. If at any time enforcement and administration
is undertaken jointly with one or more other municipalities, said
Board of Appeals shall be established by joint action of the participating
municipalities.
The following building code ordinances of Whitpain
Township are hereby specifically repealed in their entirety:
A. Ordinance No. 22-14 naming the Board of Appeals.
B. Ordinance No. 22-22 pertaining to water conservation
standards for plumbing fixture installations.
C. Ordinance 22-23 requiring the retrofit installation
of fire protection and fire signaling systems, fire resistant construction
and smoke exhaust systems.
D. Ordinance 22-30 concerning fencing of decks, spas
and hot tubs.
E. Ordinance 22-31 concerning certain exemptions for
fencing of hot tubs with covers.
Fees assessable by Whitpain Township for the
administration and enforcement undertaken pursuant to the provisions
of this Part 7 and the Uniform Construction Code shall be established
by the governing body by resolution from time to time.
