The purpose of this article is to protect the health, welfare and safety of the public by regulating the use and operation of the Copake Memorial Park located on Mountain View Road in the Town of Copake in the manner which will minimize the detrimental effects of such use on the environment, prevent accidents and prohibit the unauthorized use of said park.
As used in this article, the following words shall have the following meanings:
ALCOHOLIC BEVERAGE
Includes alcohol, spirits, liquor, wine, ale, beer, cider and every liquid or solid containing alcohol, spirits, liquor, wine, ale, beer or cider and which is capable of being consumed by a human being.
GAMBLING
The staking or risking of something of value upon the outcome of a contest of chance or a future contingent event not under his control or influence, upon an agreement or understanding that he will receive something of value in the event of a certain outcome.
GLASS CONTAINER
Any bottle or other glass receptacle, whether open or sealed, suitable for or used for the purpose of holding or containing any liquid.
GROUP
Includes but shall not be limited to any organized club, team, society or corporate organization.
LITTER
Any trash, refuse or garbage consisting of but not limited to paper and paper products, metal and metal products, glass and glass products, wood and wood products and all vegetable, animal or other waste matter, whether liquid or solid, which is likely to ferment, decompose, produce noxious odors or become injurious to the public health.

A. 
Copake Memorial Park will be closed at sundown daily, except during special park events. After dark presence is trespassing.
B. 
Licensed motor vehicles will be allowed in designated areas only. The speed limit in the park is 10 miles per hour. No other recreational vehicles allowed.
C. 
No gambling or alcoholic beverages will be permitted in the park area.
D. 
No dogs are allowed unless on a leash. Dogs are not permitted on recreational fields, courts or playground areas. Dogs are not to be tied. Please clean up after your pet.
E. 
Any group wishing to use park facilities must request permission from the Park Commission in advance.
F. 
Littering will not be tolerated. All persons using the park on any occasion will be responsible for cleanup. If tables are moved they must be returned to original locations.
G. 
The skating rink is for skating only. Skateboards are not permitted.
H. 
No glass containers; carry - in carry - out rule.
I. 
All rules and regulations are to be followed with no exceptions. Anyone found not abiding by the rules and regulations established for the Copake Memorial Park, or doing damage to the park, equipment and landscape, will be subjected to a fine of $100, imprisonment, or both.
J. 
The Copake Memorial Park will be patrolled by the Columbia County Sheriff's Department and the Copake Town police.
K. 
Fireworks are prohibited in Copake Memorial Park.

Section 172-18A of this article shall not apply to any police officer of Columbia County or to any member of the Copake Parks and Recreation Commission.
Pursuant to the authority of § 1660, Subdivision (a)18, of the Vehicle and Traffic Law of the State of New York, the operation, standing, stopping and parking of motor vehicles in the Copake Memorial Park, located on Mountain View Road in the Town of Copake, is regulated as follows:
A. 
The operating, stopping, standing and/or parking of any motor vehicle upon any area of the Copake Memorial Park, other than the roadway and the designated parking area, is prohibited.
B. 
No motor vehicle shall be left unattended or parked at any place within the Copake Memorial Park between the hours of sunset and sunrise, unless authorized by the Copake Parks and Recreation Commission or a police officer of the Town of Copake.
C. 
Subsection A of this section shall not apply to any authorized emergency vehicle while engaged in an emergency operation, to vehicles authorized by the Copake Parks and Recreation Commission or to vehicles authorized by any police officer of the Town of Copake.
D. 
Any motor vehicle which is found in violation of this article may be removed and impounded at any place designated by any police officer of Columbia County. Such impounded vehicle shall only be released upon the payment by the owner or operator thereof of the costs for such towing and storage.

A. 
Any traffic infractions as set forth in this article shall be punishable as provided in § 1800 of the Vehicle and Traffic Law.
B. 
Any person, firm or corporation who is guilty of any other violations of this article shall, upon conviction thereof, be subject to a fine of not more than $250 or imprisonment for a term of not more than 15 days, or both. Each day after notice that a violation continues shall be deemed a separate offense. In addition, a civil penalty of $100 per day may be assessed for any such violation, which civil penalty shall be recovered by the Town of Copake in a civil action.
C. 
Except as provided otherwise by law, such a violation shall not be a crime, and the penalty or punishment imposed therefor shall not be deemed for any purpose a penal or criminal penalty or punishment and shall not impose any disability upon or affect or impair the credibility as a witness, or otherwise, of any person found guilty of such an offense.
D. 
Appropriate actions and proceedings may be taken at law or in equity to prevent or remedy unlawful violations or infractions of any portion of this article, and these remedies shall be in addition to penalties otherwise prescribed by law.
Nothing contained in this article shall be construed to limit, repeal, modify or waive any other existing provisions or requirements of law or regulations, whether federal, state or local, and the provisions of this article shall be construed to be in addition to any such existing laws or regulations regulating the subject matter set forth herein.
