The purpose of this Article is to protect the
public health, welfare and safety by regulating the dumping and depositing
of solid waste and to preserve a clean, wholesome and attractive environment
in the Town of Copake.
As used in this Article, the following words
shall have the meanings established below:
SOLID WASTE
Consists of the following:
A.
GARBAGEAll waste, vegetable, animal or other matter, liquid or solid, likely to ferment or decompose, produce noxious odors or become injurious to the public health.
B.
REFUSETrash and litter, whether or not combustible, consisting of but not limited to paper and paper products; wood and wood products; metal and metal products; glass and glass products, ashes, dust and dirt, rock, concrete or other materials, including earth wastes from building operations and solid waste residue from industrial processes and manufacturing operations, all rubber products, sewerage and septic waste.
C.
CONSTRUCTION DEBRISAny scrap lumber, metal, earth, sand, brick, stone, plaster, roofing and siding material or other debris of a similar nature which accumulates or is incidental to the construction or renovation of homes, buildings, public works or other projects.
D.
BULK ITEMSAny large, heavy and/or bulky household appliances, furniture or furnishings.
TRANSFER STATION
The Columbia County Solid Waste Transfer Station located
on County Route 7A, Center Hill Road, in the Town of Copake.
No person shall cause to be dumped, deposited
or thrown any solid waste in or upon any highway, highway right-of-way
or land within the Town of Copake, except at the Columbia County Transfer
Station.

A. Any person, firm or corporation who is guilty of a
violation of this article shall, upon conviction thereof, be subject
to a fine of not more than $250 or imprisonment for a term of not
more than 15 days, or both. Each day after notice that a violation
continues shall be deemed a separate offense. In addition, a civil
penalty of $100 per day may be assessed for any such violation, which
civil penalty shall be recovered by the Town of Copake in a civil
action.
B. Except as provided otherwise by law, such a violation
shall not be a crime, and the penalty or punishment imposed therefor
shall not be deemed for any purpose a penal or criminal penalty or
punishment and shall not impose any disability upon or affect or impair
the credibility as a witness, or otherwise, of any person found guilty
of such an offense.
C. Appropriate actions and proceedings may be taken at
law or in equity to prevent or remedy unlawful violations or infractions
of any portion of this article, and these remedies shall be in addition
to penalties otherwise prescribed by law.
Nothing herein shall be construed to limit,
repeal, modify or waive any existing provisions or requirements of
law or regulation, whether federal, state or local law; but on the
contrary, this Article and the provisions herein shall be in addition
to any present law or regulation relating to the subject matter set
forth herein.
