The Town of Cornwall has been directed to enact a mandatory recycling
program in order to comply with the directives of the County of Orange, which
has been ordered to institute a recycling program by the Department of Environmental
Conservation. The Town Board determines that conservation of recyclable materials
is now a necessity in order to conserve our material resources and that the
cost of solid waste disposal is ever increasing while landfill facilities
are rapidly decreasing. The Town Board recognizes that the Town of Cornwall
should participate in recycling as part of a nationwide recognition of the
importance of conservation and good stewardship.
In this chapter, the following words and phrases shall have the meanings
respectively set forth below:
CONTRACTOR
The solid waste hauler under contract with the town.
GLASS
All products made from silica or sand, soda, ash and limestone, the
product being transparent or translucent and being used for the packaging
or bottling of various materials, excluding blue glass, ceramic, plate glass,
window glass and light bulbs.
NEWSPAPER
All paper of the type commonly referred to as newsprint and distributed
at slated intervals, having printed thereon news, opinions, advertisements
or other matters of public interest; expressly excluded from "newspapers"
are all magazines which are not distributed as part of newspapers.
PERSON
Individuals, partnerships, corporations, owners, tenants, lessees
or occupants residing, owning, operating, managing, leasing or occupying any
premises, including residential, business, commercial or industrial, within
the unincorporated area of the town.
RECYCLING
Any process by which materials which would otherwise become municipal
solid waste and which may be collected, separated or processed.
RECYCLING DROP-OFF CENTER
Any facility designed and operated solely for receiving, storing,
processing and transferring source-separated recyclable materials as designated
by the Town Board.
TOWN
The Town of Cornwall, Orange County, New York.
TOWN BOARD
The Town Board of the Town of Cornwall, Orange County, New York.
WASTE STREAM
Solid waste produced by residential, business, commercial and industrial
generators within the town.
A program for the mandatory separation of the following components in
the waste stream is hereby established in the town: newspaper and clear glass,
cardboard and office paper.
If the contractor determines that any person shall have failed to comply
with the mandatory source separation of materials in accordance with this
chapter, the contractor shall have the right to decline to pick up any solid
waste from the person, including but not limited to the solid waste which
is mandated by this chapter to be source-separated for recycling.
Any person who shall violate any of the provisions of this chapter shall,
upon conviction, be deemed to have committed an offense against this chapter
and shall be punishable by a fine not exceeding $100. In addition to the above
penalty, the Town Board may also maintain an action or proceeding in the name
of the town to compel compliance with or to restrain by injunction the violation
of the terms of this chapter.
