A. 
Complaints by individuals shall be made in writing to the Town Code Enforcement Officer with supporting information that an on-site wastewater treatment system may be in failure. Such information may include, but is not limited to, samples of groundwater, surface water, or photos of aboveground seepage, or conditions otherwise creating a public nuisance.
B. 
If, after further investigation by the Town Code Enforcement Officer (CEO), there is due cause, the CEO shall notify the property owner and the inhabitants of the property, in writing, within seven business days or receipt of the complaint and shall request access to the property to further investigate the potential failure. A copy of such notice shall also be sent to the Town Clerk.
C. 
The CEO shall follow the procedures in Article IV of this chapter to gain access to the parcel and, depending upon findings of the investigation, the CEO will follow procedures established to remedy any deficiencies.
