The Village Board of the Village of Greene recognizes the suburban nature of the Village and that no part hereof is suitable for the maintenance of wild animals or poultry. The Board is mindful of both the safety and welfare of the residents of the Village and the interest of preventing cruelty to such animals, the creation of hazard by their presence and the noise and odor generated from their presence.
As used in this chapter, the following terms shall have the meanings indicated:
DWELLING UNIT
A building or portion thereof providing complete housekeeping facilities for one family.
POULTRY
Includes chickens, ducks, geese, turkeys and other poultry and domestic birds used for food purposes, and shall include pigeons.
WILD ANIMALS
An animal of any species which in its natural habitat is wild, dangerous or ferocious, including any such animal which may have been trained and domesticated. "Wild animals" shall include but not be limited to the following: all members of the dog family, except domestic dogs; all members of the cat family, except the common domestic cat; all predator birds, such as eagles, hawks, falcons and owls; all venomous snakes or constricting snakes; all venomous lizards, snapping turtles and alligators; and iguanas.
A. 
It shall be unlawful for any person or persons to allow or permit any cattle, horses, swine, goats, sheep, poultry or other animals to run at large or to be herded or pastured upon any street within the Village of Greene.
B. 
It shall be unlawful to pasture or house cattle, horses, swine, goats, sheep, poultry or other animals within the Village of Greene except by special permit.
C. 
Dogs, cats and other household pets are not included under the provisions of Subsections A and B above.
D. 
It shall be unlawful for the owner or occupant of a dwelling unit to harbor dogs, cats and other household pets in a manner unacceptable to the local health officer or a local veterinarian, said official to be authorized by the mayor.
E. 
It shall be unlawful for any person or persons to maintain a kennel, to board animals or to maintain a pigeon loft, etc., within the Village of Greene except by special permit.
F. 
The owners of all animals within the Village boundaries shall comply with state immunization laws (i.e., rabies).
A. 
Possession restricted. No person shall keep, harbor or possess a wild animal in any place within the Village of Greene other than the following:
(1) 
A zoological park.
(2) 
A laboratory operated pursuant to the Public Health Law.
(3) 
A carnival, circus or a public outdoor show for which a special permit from the Village Board has been obtained.
(4) 
An educational or scientific institution chartered or licensed by the State of New York.
B. 
All wild animals possessed pursuant to Subsection A shall be kept in protective devices which are adequate to prevent such animals from escaping or injuring the public.
C. 
No wild animals shall be offered for sale, sold or given to any person or institution in the Village of Greene.
A. 
The Village Board may issue specific permits as stated above after considering the relevant factors in each case. Standards to be considered in determining whether to issue a special permit include the following:
(1) 
The kind of animal or animals to be pastured or housed in the Village.
(2) 
The number of animals.
(3) 
The type of housing or enclosure.
(4) 
The risk of danger to the public or to domestic animals.
(5) 
The risk of danger to the animals.
(6) 
The proximity of neighbors.
(7) 
The character of the neighborhood.
(8) 
The zoning district.
(9) 
Any other factors deemed relevant by the Village Board.
B. 
Nonconforming uses. In the event that a resident is in violation of this chapter at the time of its passage, said resident shall have one year from the date said chapter is enacted to comply therewith.
Any person who shall violate any of the provisions of this chapter shall be punished by a maximum fine of $250 or a term of imprisonment not to exceed 15 days in jail, or both.
