It is the purpose of this chapter to promote and protect the public health, safety and general welfare by providing for the regulation of planting, maintenance and removal of trees within the Village of Greene.
There is hereby created and established a Tree Board for the Village of Greene which shall consist of the Superintendent of Public Works, the Superintendent of the Electric Department and the Trustees who are in charge of these departments.
This chapter provides full power and authority over all trees, plants and shrubs located within street rights-of-way and park and public places in the Village of Greene and on private property, as described in § 113-6.
No trees may be planted under or within 10 lateral feet of any overhead utility wire or over or within five lateral feet of any underground waterline, sewer line or other utility, except with prior Tree Board approval.
No person shall plant, remove, cut above the ground or disturb any tree on any street, park or other public place without approval of the Tree Board.
Any member of the Tree Board has the authority to enter private property where there is located a tree, shrub, plant or plant part that is suspected to be a public nuisance or hazard and to order its removal or trimming, if necessary. The Village may, at its discretion, remove or trim any tree, shrub, plant or plant part which may be interferring with a public utility operation.
Any person violating any provision of this chapter shall be, upon conviction or a plea of guilty, subject to a fine not to exceed $250.
