The owner of every dog shall be held responsible for every behavior of such dog under the provisions of this chapter. Dog owners shall ensure that their dog carries identification at all times in the form of microchip, tag, or other means to allow easy determination of the owners. No person who owns, possesses or harbors a dog shall permit, allow, suffer or tolerate such dog to run loose or at large in the Village except on the premises of the owner or on the premises of another with his consent. No such dog shall be permitted at any time to be within said Village except on the premises of the owner or on the premises of another with his/her consent unless effectively restrained in the immediate custody of the owner or custodian of the dog by a chain or leash not exceeding six feet in length.
Any person owning, possessing or harboring a dog who shall fail to exercise due care in preventing such dog from running loose and at large shall be guilty of a violation of this article. The presence of any dog which is loose and at large shall be presumptive evidence that the person who owns, possesses or harbors such dog suffers or tolerates it to be loose and at large in violation of this article and shall be presumptive evidence that such person has failed to exercise due care in preventing such dog from running loose and at large in violation of this article.
A. 
Seizure. Any dog found at large in the Village and not under effective restraint by a chain or leash not exceeding six feet in length as aforesaid shall be seized by a police officer or by the duly appointed Animal Control Officer of the Town of Oyster Bay (the "Town") and shall be impounded at the Town Animal Shelter until redemption, adoption or destruction. A police officer or Animal Control Officer may also seize a dog that, upon reasonable knowledge and belief, has been at large and not under continuous effective restraint and is suspected of having acted or behaved in a dangerous manner as provided in Article IV of this chapter.
B. 
Evaluation. Any dog seized shall be evaluated at the Town Animal Shelter to determine if it has aggressive behavior patterns which demonstrate that it has the propensity to become a dangerous dog. Any police officer or Animal Control Officer may file a dangerous dog complaint under § 121 of the Agriculture and Markets Law and Chapter 103, Article III of the Code of the Town of Oyster Bay with a justice or judge having jurisdiction over such dog if he has reasonable cause to believe that it has the propensity to become a dangerous dog. The cost of any such evaluation shall be at the dog owner's expense.
If the dog seized bears a license tag or other identification, the Animal Control Officer of the Town of Oyster Bay or an officer or representative of the Village shall ascertain the owner of the dog and shall give immediate notice by either personally serving on or mailing by first-class and certified mail, return receipt requested, to such owner or an adult member of his/her family, a written notice stating that the dog has been seized and will be sold or otherwise disposed of unless redeemed within the period provided in § 82-7 hereof. If the dog seized does not bear such identification, the Animal Control Officer or officer or representative of the Village shall make a reasonable effort to identify and give such notice to the owner of the dog. An unlicensed dog may be put up for adoption or destroyed in accordance with the rules and procedures of the Town of Oyster Bay Animal Shelter without any notice to its owner.
The owner of a dog seized by the Animal Control Officer of the Town of Oyster Bay and kept in the Town Animal Shelter may redeem said animal as stated in the Town redemption procedures and conditions, including but not limited to the fee schedule relating to such redemptions. If not so redeemed, the owner shall forfeit all title to the dog and the dog shall be offered for adoption or destroyed as determined by the Director of the Town of Oyster Bay Animal Shelter.

Any dog or dogs harbored or kept by any person on any premises owned or occupied by such person within the Village shall not cause frequent or long continued noise so as to disturb the comfort or repose of any person or persons in the vicinity.
