When any vehicle is deemed to fit the following
criteria such vehicle may be removed or caused to be removed by the
Village of Hamburg in the manner herein provided.
A. Found to be an abandoned vehicle within the meaning
of Section 1224 (1, a-d) of the Vehicle and Traffic Law;
B. Used or operated by a person in violation or alleged
violation of Sections 511 (2) of 511 (3) of the Vehicle and Traffic
Law;
C. Used by a person in violation or alleged violation
of Section 1192 of the Vehicle and Traffic Law;
D. Evidence required in connection with the trial of
any person charged with a crime; or
E. Parked or allowed to stand on any public street or
public parking lot during a snow storm, flood, fire or other public
emergency
The Village of Hamburg may, in any calender
year, convert to Village use up to 1% of the Village's unclaimed abandoned
vehicles or two such vehicles, whichever is greater, provided that
each such vehicle at the time of removal had number plates affixed
and was of a wholesale value, taking into consideration the condition
of the vehicle, of more than $750.
The last owner or the last known owner of a
vehicle shall be liable to the Village of Hamburg or to the agency
effecting the removal and storage of the vehicle.
