Pursuant to the provisions of § 806
of the General Municipal Law, the Board of Trustees of the Incorporated
Village of Old Westbury hereby adopts a Code of Ethics setting forth
for the guidance of its officers and employees the standards of conduct
reasonably expected of them. The rules of ethical conduct contained
in this chapter as adopted shall not conflict with but shall be in
addition to any prohibition of Article 18 of the General Municipal
Law or any other general or special law relating to ethical conduct
and interest in contracts of municipal officers and employees.
The terms "interest" and "officer or employee"
shall have the meanings ascribed to them in § 800 of the
General Municipal Law.
Every officer or employee of the Incorporated
Village of Old Westbury shall be subject to and abide by the following
standards of conduct:
A.
When he participates in the discussion of or gives
official opinion to the Board of Trustees on any legislation pending
before it, he shall, to the extent that he knows thereof, disclose
to the Board of Trustees any interest he has in such legislation.
B.
He shall not invest or hold any investment directly
or indirectly in any financial, business, commercial or other private
transaction which creates a conflict with his official duties.
C.
He shall not engage in, solicit, negotiate for or
promise to accept private employment or render services for private
interests when such employment or service creates a conflict with
or impairs the proper discharge of his official duties.
D.
He shall not, after termination of service or employment
with the Village of Old Westbury, appear before any Board or agency
of the Village in relation to any case, proceeding or application
in which he personally participated during the period of his service
or employment or which was under his active consideration.
There is hereby established a Board of Ethics
consisting of three members who shall be appointed by the Board of
Trustees and who shall serve without compensation and at the pleasure
of the Board of Trustees. A majority of such members shall be persons
other than officers or employees of the Village but shall include
at least one member who is an elected or appointed officer of the
Village. The Board of Ethics shall have the powers and duties prescribed
by Article 18 of the General Municipal Law and shall render advisory
opinions to the officers and employees of the Village with respect
to Article 18 of the General Municipal Law and to this Code of Ethics,
under such rules and regulations as the Board of Ethics may prescribe.
In addition, the Board may make recommendations with respect to the
drafting and adoption of a Code of Ethics or amendments thereto upon
request of the Board of Trustees.

It is hereby required that Village officers and employees, as
those terms are defined in this chapter, shall annually file a statement
of financial disclosure in such form as may be promulgated from time
to time by the Board of Trustees, with the Board of Ethics and the
Village Administrator. The financial disclosure statement shall be
filed on or before the 15th day of May with respect to the preceding
calendar year, unless otherwise permitted to be filed at another time.
