Any person who, with intent to provoke the public peace and
good order of the Village or whereby a breach of the peace and good
order may be occasioned, commits any of the following acts shall be
deemed to have committed the offense of disorderly conduct:
A. Engages in fighting or in violent, tumultuous or threatening behavior;
or
B. Makes unreasonable noise; or
C. In a public place, uses abusive or obscene language, or makes an
obscene gestures; or
D. Without lawful authority, disturbs any lawful assembly or meeting
of persons; or
E. Obstructs vehicular or pedestrian traffic; or
F. Congregates with other persons in a public place and refuses to comply
with a lawful order of the police to disperse; or
G. Loiters in a public place and refuses to comply with a lawful order
of the police to disperse; or
H. Creates a hazardous or offensive condition by any act which serves
no legitimate purpose; or
I. Urinates or defecates in any public place; or
J. In a public place, or in circumstances where he or she can be observed
by a person in a public place, or by a person from another private
premises, and with intent that he or she be so observed, intentionally
exposes the private or intimate parts of his or her body in a lewd
manner or commits any other lewd act.
K. Smoking
on any property owned by the Village of Old Westbury, including all
Village roads and in the right-of-way. "Smoking" shall mean the burning
of a lighted cigar, cigarette, pipe, or any other matter or substance
which contains tobacco or cannabis as defined in § 222.00
of the Penal Law, or cannabinoid hemp as defined in § 3
of the Cannabis Law.

Any person violating any provision of this chapter shall be
liable for and pay a penalty of not less than $1,000 and not more
than $2,500 for each and every offense, and in addition thereto, such
conduct shall constitute and is hereby declared to be disorderly conduct,
and any person violating the same shall be and is hereby declared
to be a disorderly person.
