The City Council hereby finds and declares as a matter of legislative determination that it is in the best interest of the residents of the City of Watervliet to prohibit topless entertainment in the City of Watervliet and that this section be enacted.
A female is guilty of exposure when, in a public place in the City of Watervliet at any time, whether or not such female is entertaining or performing in a play, exhibition, show or entertainment, she appears clothed or costumed in such a manner that the portion of her breast below the top of the areola is not covered with a fully opaque covering.
A person is guilty of promoting the exposure of a female when said person knowingly conducts, maintains, owns, manages, operates or furnishes any public premises or place in the City of Watervliet where, at any time, whether or not such female is entertaining or performing in a play, exhibition, show or entertainment, a female appears clothed or costumed in such a manner that the portion of her breast below the top of the areola is not covered with a fully opaque covering.
" Public place" is defined in accordance with § 240.00 of the New York State Penal Law and acts amendatory thereof.
Anyone found in violation of any provision of this chapter shall be subject to a penalty as set forth in Chapter 1, General Provisions, Article III, General Penalty.
