Whenever it shall be made to appear to the Mayor
and the police and the Sanitary Committee of the Borough of Catasauqua
that unowned pigeons constitute a nuisance in and about the streets,
parks or other public property within the Borough of Catasauqua, it
shall be lawful for the Mayor and Police Department to provide for
the destruction or killing of such unowned pigeons by any humane means.
Members of the Police Department or persons
duly authorized by the Police Department may, upon request of the
owners of private property, enter upon such property to eradicate
unowned pigeons constituting a nuisance thereon in such manner as
shall be directed by the Chief of Police of the Borough of Catasauqua,
provided that such request be accompanied by a release of liability
to the Borough of Catasauqua, its agents, servants and employees for
injury to persons and damage to property which may occur in the eradication
of unowned pigeons, in such form as may be required by the Police
Department of the Borough of Catasauqua.
Nothing herein contained shall purport to authorize the entry upon private property or the discharge of firearms or air rifles thereon without specific request of the owner or occupant thereof as provided in §
105-2 hereof.
