The following words when used in this article
shall, unless the context clearly indicates otherwise, mean or include
as follows:
PERSON
Any natural person, firm, copartnership, association or corporation.
STREET
Every way or place of whatever nature within the Borough
of Catasauqua, open to the use of the public as a matter of right,
for purpose of vehicular travel.
VEHICLE
Any device in, upon or by which any person or property is
or may be transported or drawn upon a public street.

A. Except as hereinafter provided in Subsection
A of this §
230-23.1, no person shall dump, deposit, or place any material, equipment, or furniture within the cartway of any street or alley of the Borough, including the parking lanes, whether it be to reserve a parking space, for personal convenience or any other reason. Such placement is declared to be a traffic obstruction and hazard.
B. Roll-off containers, dumpsters, and other containers
used for the collection and eventual disposal of building construction
waste and similar materials shall be allowed within the parking lane
of any street with a cartway width of more than 20 feet and may extend
no more than four feet into any street with a cartway width of less
than 20 feet, upon obtaining a permit from the Borough to do so.
Containers must be placed in a location at which a motor vehicle would
be legally allowed to park, and in no case will the placement of a
container be allowed where it would effectively, or actually, close
a road to vehicular traffic. The property owner shall ensure that
reflective tape, cones, and/or flashers are placed around all sides
of any dumpster or other container placed within the public right-of-way,
either the sidewalk area or the cartway of any road.

Any permit issued under this subsection shall
be for a period of 30 consecutive days with a maximum of two automatic
consecutive additional thirty-day permit periods hereby authorized.
The fee for each thirty-day permit, or any additional thirty-day
period, shall be set by resolution of Borough Council.

Prior to the issuance of any permit under this
subsection, the property owner shall provide a certificate of insurance
(or, upon request, the full insurance policy) to the Borough covering
all claims that may arise in whole or in part from the placement or
use of the roll-off container, dumpster or other containers. The
policy of insurance shall name the Borough as an additional insured
and it shall specifically state that it is primary over any other
applicable Borough insurance. The amount of the liability insurance
shall be a minimum amount of $1,000,000, and there shall be no general
aggregate applicable to this insurance.
It shall be unlawful for any person to remove
snow or ice from private property and to put, place or deposit or
cause to be put, placed or deposited snow or ice so removed upon the
right-of-way of any street.
It shall be unlawful for any person to remove
or cause to be removed snow or ice from any sidewalk or footway and
put, place or deposit, or cause to be put, placed or deposited snow
or ice so removed upon that portion of the street normally used for
the travel of vehicles; however, this shall not be intended to prohibit
putting, placing or depositing snow or ice upon a portion of the street
normally used for vehicles where there is no available private property
within a reasonable distance upon which to put, place or deposit the
snow or ice so removed.
