ABANDONMENT (SIGN)
Any nonconforming or conforming but obsolete (sign remains, use abandoned) sign which does not comply with § 115-92H will be removed and will be subject to Article XVII.

ACCESSORY STRUCTURE
A nonhabitable building or structure subordinate and not attached to the principal building on a lot and used for purposes customarily incidental to those of the principal building including but not limited to detached garages, sheds, barns, decks, tennis courts, pools and other similar items.

ACCESSORY USE
A use subordinate to the principal use of land or of a building on a lot and customarily incidental thereto.
ACT
The Pennsylvania Municipalities Planning Code, Act 247 of 1968, as amended and reenacted by Act 1970 of 1988, 53 P.S. § 10101 et seq., and any subsequent amendments thereto.

ADAPTIVE REUSE
Method of preservation where a building retains its signature visual elements, but the structure is used for a purpose other than originally intended.

AGRICULTURAL OPERATIONS
An enterprise that is actively engaged in the commercial production and preparation for market of crops, livestock and livestock products and in the production, harvesting and preparation for market or use of agricultural, agronomic, horticultural, silvicultural and aquacultural crops and commodities. The term includes an enterprise that implements changes in production practices and procedures or types of crops, livestock, livestock products or commodities produced consistent with practices and procedures that are normally engaged by farmers or are consistent with technological development within the agricultural industry.

ALLEY
A private street providing vehicular access to the side or rear of two or more properties.

ALTERATIONS
As applied to a building or structure, any change or rearrangement in the structural parts or in the means of egress; or an enlargement, whether by extending on a side or by increasing in height; or the moving from one location or position to another.[1]

ANCHORING
The fastening of the mobile home to its pad (or stand) in order to prevent upset or damage due to wind, erosion, flooding or other natural forces.

ANGLED PARKING
Parking stalls proposed at an angle (other than 90° or radial to any curved alignments) to the center line of the Parking Field Drive Aisle accessing the stall.

ANTENNA
A system of wires, rods, discs, panels, flat panels, dishes, whips, or other similar devices used for the transmission or reception of wireless signals. An antenna may include an omnidirectional antenna (rod), directional antenna (panel), parabolic antenna (disc) or any other wireless antenna. An antenna shall not include tower-based wireless communications facilities as defined below.

ARTISAN SIGN
A temporary advertising sign of workers or businesses (such as carpenters, painters, plumbers, roofers and landscapers, etc.) performing services at or alterations to a building or premises.

ASSISTED LIVING FACILITY
A building or group of buildings used or occupied for residential purposes by persons over 55 years of age, providing permanent residential accommodations consisting of assisted or personal care units having full living spaces, including kitchen facilities, and including provisions for meal service in a congregate dining facility for substantially all meals along with medication and other personal care services.

BANNER
A temporary sign of cloth or other nonrigid material meant to be tethered to fixed structures, such as light posts or other utility uprights, and may be across public ways with the permission of the utility and the affected right-of-way jurisdiction announcing a noncommercial event, such as a parade, special celebration by a not-for-profit organization and public service notices by governmental entities. A banner shall not be a commercial announcement.

BASE FLOOD
A flood which has a one-percent chance of being equaled or exceeded in any given year (also called the "one-hundred-year flood" or one-percent-annual-chance flood).

BASE FLOOD DISCHARGE
The volume of water resulting from a base flood as it passes a given location within a given time, usually expressed in cubic feet per second (cfs).

BASE FLOOD ELEVATION (BFE)
The elevation shown on the Flood Insurance Rate Map (FIRM) for Zones AE, AH, A1-30 that indicates the water surface elevation resulting from a flood that has a one-percent or greater chance of being equaled or exceeded in any given year.

BASEMENT
Any area of the building having its floor below ground level on all sides (for flood loads only) and a story that is not a story above grade plain (for all other applications).

BED-AND-BREAKFAST COMMON AREA
That area available on the first floor (grade level) of a bed-and-breakfast estate which shall be the only interior area used for the conduct of weddings, wedding receptions, small parties and special events. The common area shall be exclusive of the owner's living area.

BED-AND-BREAKFAST ESTATE
An owner-occupied Class I historic resource with at least four, but no more than 10, guest rooms, common areas and exitways for short-term overnight rental, with provisions for breakfast service for the overnight guests. In addition, there may be weddings, wedding receptions, small parties and special events.

BED-AND-BREAKFAST FACILITY
A use accessory to an owner-occupied, single-family detached dwelling, consisting of guest rooms available for short-term overnight rental and the provision of breakfast service to overnight guests.

BICYCLE BOULEVARD
A street corridor treatment that prioritizes and enhances bicycle travel via traffic-calming measures, signs, pavement, markings, and crossing improvements.

BICYCLE RACK
A permanent fixture to facilitate bicycle parking to which bicycles can be securely attached (typically using a bicycle lock) to prevent theft.

BIKE LANE
Designated travel lanes within the cartway or along the road shoulder for exclusive use by bicyclists. Bike lanes typically involve a combination of supplemental indicators, including but not limited to Share the Road signs, sharrows, and other pavement markings.

BLOCK
An area of land bounded by streets.
BOARD
The Board of Supervisors of East Bradford Township.
BUFFER/BUFFER PLANTINGS and SCREEN/SCREEN PLANTINGS
Vegetation of a specific composition and density required to be placed within a buffer yard for the purpose of controlling views of a land use or to protect a natural and/or historic resource.

BUFFER YARD
An area designed and functioning to separate and visually minimize views of the elements and uses of land which abut it. The intensity of buffering shall be determined by the abutting land uses and shall be accomplished through the strategic placement of vegetative and nonvegetative elements.

BUILDING
A combination of materials to form a permanent structure having walls and a roof. Included shall be all manufactured homes and trailers to be used for human habitation.

BUILDING COURT
Common parking fields servicing a single building or multiple buildings, segregated from the remainder of a subdivision or land development by a public roadway or private roadway with public right-of-way and raised upright curbing as required by §§ 115-56 and 115-58, connected to the public or private roadway via a main access driveway.

BUILDING COVERAGE
The ratio of the total ground floor area of all buildings on a lot to the total area of the lot on which they are located.

BUILDING HEIGHT
The vertical distance measured from grade plane to the average height of the highest roof surface.

BUILDING SETBACK LINE
An established line within a property defining the minimum required distance between any structure to be erected and an adjacent right-of-way or street line.
BUILDING SIDES
For the purpose of this chapter, each of the following shall be a building side:

BUILDING FRONTThat facade oriented toward the front yard as defined. Angles and alcoves shall be part of that facade.
(2)

BULK
A term used to describe the size of buildings or other structures and their relationships to each other, to open areas, such as yards, and to lot lines, and used in conjunction with such expressions as:
(1) 
The size, including height and floor area, of buildings and other structures.
(2) 
The relation of the number of dwelling units in a residential building to the area of the lot.
(3) 
All open areas in yard space relating to buildings or other structures.
BULLETIN BOARD or MENU BOARD
A permanent freestanding or wall-mounted sign with movable letters, words or numerals indicating the names of persons associated with or events conducted upon, or products or services offered upon, the premises upon which such a sign is maintained.

BUSINESS SIGN
A sign directing attention to a business, commodity or service conducted, sold or offered upon the same premises as those upon which the sign is maintained.

BUS SHELTER
A pedestrian amenity located at a bus stop to provide convenience, comfort, and shelter from the elements in the form of a structure such as a canopy.

CERTIFIED HISTORIC DISTRICT
An historic district which has been delineated by East Bradford Township and certified for historical significance by the Pennsylvania Historical and Museum Commission in accordance with Pa. Act 167 of 1961.[3]

CERTIFIED HISTORIC STRUCTURE
A building or other structure identified by East Bradford Township and listed in the National Register of Historic Places or located within a registered historic district and certified by the Secretary of the Interior as being of historical significance to the district.

CHARACTERISTIC LANDSCAPE ELEMENTS
Topographic, vegetative and structural features of the landscape typically viewed from public roads or rights-of-way within East Bradford Township, including but not limited to:

(2) 
Woodlands, tree lines, hedgerows and visually prominent individual trees.

CLEAR CUTTING
The felling of all trees on a tract of land, or any portion thereof, at one time.[5]

CO-LOCATION or CO-LOCATED
The mounting of one or more WCFs, including antennas, on an existing tower-based WCF, or on any structure that already supports at least one non-tower WCF.

COMMUNITY LIVING ARRANGEMENT
Any of the following facilities licensed, operated or permitted under the authority of the Department of Welfare of the Commonwealth of Pennsylvania or other state department or agency: group foster homes for children; community residential facilities for the mentally retarded, disabled or challenged; community residential facilities for the psychiatrically disabled; and family-based group homes. This definition does not include day-care centers, nursing homes, general or special hospitals, prisons or jails.

COMMUNITY SPACE
Areas containing community amenities, including but not limited to plazas, mail kiosks, game courts, gazebos, dog parks, etc.

COMPLETELY DRY SPACE
A space which will remain totally dry during flooding; the structure is designed to prevent the passage of water and water vapor.

CONFERENCE CENTER
A building or assemblage of buildings designed as a place to accommodate university faculty, staff, students and visitors for the purpose of holding or conducting meetings or conferences. A conference center may be constructed to provide accommodations for a limited number of visiting attendees.

CONGREGATE CARE CAMPUS
A building or group of buildings on a lot dedicated primarily to the care of the elderly and consisting of two or more of the following uses:

Community resources center.
(2) 
Day-care center for adults.
(3) 
Assisted living facilities.
(4) 
Nursing home (extended care facility).
(5) 
Uses accessory to and located on the same lot as the congregate care campus, including but not limited to medical clinics, professional offices and medical testing laboratory facilities, provided that such uses shall be an integral part of the congregate care campus and shall be operated and maintained substantially in conjunction with the congregate care campus facilities.
CONTRIBUTING RESOURCE
A resource in an historic district or historic complex which, as filed with the National Register or the Bureau for Historic Preservation, support the district's or complex's historical significance through location, design, setting, materials, workmanship, feeling and association.

CONVENIENCE STORE
A commercial use, principally engaged in the sale of retail goods for individual and household consumption, that is limited in size and intended to provide service primarily to a local neighborhood. Such a use shall be classified as a convenience store if, at minimum, it offers for sale the following items: groceries, household dry goods and prepared or take-out foods (hot and/or cold) intended for consumption off the premises. Any location for a convenience store shall be characterized by well-managed vehicular access and sufficient parking.

CROSSWALK
A public right-of-way used for pedestrian travel across a roadway or traffic aisle at an intersection or any portion of a block to provide safe pedestrian access to adjacent roads, lots, parking areas, sidewalks, or public use areas.

CUMULATIVE SUBSTANTIAL DAMAGE
Flood-related damages sustained by a structure on two separate occasions during a ten-year period for which the cost of repairs at the time of each such flood event, on average, equals or exceeds 25% of the market value of the structure before the damages occurred.

DAY-CARE CENTER
Any premises operated for profit in which adult or child day care is provided simultaneously for six or more adults or children who are not relatives of the operator. "Relative," for the purposes of this definition, means parent, guardian, child, stepparent, stepchild, grandparent, grandchild, brother, sister, half-brother, half-sister, aunt, uncle, niece or nephew.

DBH (Diameter at breast height)
The point at which existing trees located upon a property are to be measured. The measurement shall be taken at 4 1/2 feet above mean ground level.

DECLARATION OF LAND RESTRICTION (NON-CONVERSION AGREEMENT)
A form signed by the property owner to agree not to convert or modify, in any manner that is inconsistent with the terms of the permit and these regulations, certain enclosures below the lowest floor of elevated buildings and certain accessory structures. The form requires the owner to record it on the property deed to inform future owners of the restrictions.

DEMOLITION
The razing or destruction, whether entirely or in part, of a building, structure, site or object. "Demolition" includes the removal of any building, structure or object from its site, or the removal or destruction of the facade or surface.

DETERMINATION OF ELIGIBILITY (DOE)
An historic resource determined by the Secretary of the Interior as meeting the National Register criteria, but which is not listed in the National Register.

DEVELOPMENT
Any man-made change to improved or unimproved real estate, including but not limited to the construction, reconstruction, renovation, repair, expansion or alteration of buildings or other structures; the placement of manufactured homes; streets and other paving; utilities; filling, grading and excavation; dredging; drilling operations; storage of equipment or materials; and the subdivision of land.

DEVELOPMENT AREA
A specific area designated within the PU Planned University District intended to be devoted to the construction of a building or buildings for uses permitted in the PU Planned University District and proposed to be constructed and completed under a single development plan. The development area shall include the required open space in accordance with the terms of this chapter and Article XXIII.

DEVELOPMENT SIGN
A temporary sign pursuant to § 115-94 indicating that a site or premises is in the process of being subdivided and developed for the construction of dwellings or other buildings.

DIGITAL SIGN
Any sign capable of displaying words, symbols, figures or images that can be electronically or mechanically changed by remote or automatic means.

DINING HALL
A structure, or part of a structure, within the university campus used to receive, store (dry and/or cold), prepare and serve food products to students, faculty, staff and visitors to the university. Food may be served in the dining hall or may be provided for take-out. A dining hall may be operated by the University or by contract between the university and a private firm, or by a combination of both, provided that there shall be no exterior advertisement regarding the private firm or firms operating the dining hall. Seating capacity in dining halls shall be limited to 500 persons.

DIRECTION SIGN
A sign conveying instructions with respect to the premises on which it is maintained, such as the entrance and exit of a parking area, a drive-through, a warning sign, a danger sign and similar information signs.

DIRECTORY SIGN
A sign with or without legend announcing businesses within a planned commercial development or industrial complex.

DISTRIBUTED ANTENNA SYSTEMS (DAS)
A network of spatially separated antenna sites connected to a common source that provides wireless service within a geographic area or structure.

DISTRICT, HISTORIC
A geographically definable area (urban or rural, small or large) possessing a significant concentration, linkage or continuity of sites, buildings, structures or objects united by past events or aesthetically by plan or physical development.

DOMESTIC WASTE
Normal wastes from kitchens, water closets, lavatories and laundries in residences, offices, hotels, stores, restaurants, hospitals, schools, commercial establishments, industrial establishments and similar services.

DOUBLE-FACED SIGN
A sign with two identical and parallel faces with a singular means of support.

DOUBLE PARKING
Parking stalls proposed in parallel or in series where a vehicle parked in the interior stall cannot exit the stall unless a vehicle parked in the exterior stall first exits.

DRIPLINE
A generally circular line, the circumference of which is determined by the outer reaches of a tree's widest branching points.

DUMP
A lot or portion of a lot used for the deposit and storage of refuse, including, but not by way of limitation, garbage, ashes and rubbish. The definition of "dump" does not include a sanitary landfill as defined by this chapter when operated in accordance with standards established by the Pennsylvania Department of Health or the Chester County Health Department.
DWELLING UNIT
A building or entirely self-contained portion thereof containing complete housekeeping facilities, for occupancy by only one family (including any domestic servants living or employed on the premises) with no enclosed space (other than vestibules, entrances or other hallways or porches) in common with any other dwelling unit. Dwelling units may be contained in the following structures:

(1) 
SINGLE-FAMILY DETACHED—A building having only one dwelling unit from ground to roof, independent outside access and open space on all sides.
(2) 
TWO-FAMILY—A building containing two dwelling units (detached, semidetached or attached), including but not limited to twin or duplex:
(a) 
TWIN—A building containing two dwelling units, separated by a party wall, each having independent outside access and open space on three sides.
(b) 
DUPLEX—A building containing two dwelling units from ground to roof, each of which has independent outside access and open space on all sides.
(3) 
MULTIFAMILY—A building containing three or more dwelling units, including four-family dwellings (fourplex, quadraplex), townhouses (single-family attached) and apartment buildings.
(a) 
FOUR-FAMILY DWELLING (FOURPLEX, QUADRAPLEX)—A building containing four dwelling units, each of which has independent outside access, two nonparallel walls in common with adjacent dwelling units and open space on two nonparallel sides.
(b) 
TOWNHOUSE (SINGLE-FAMILY, ATTACHED)—A building containing not more than seven dwelling units separated by parallel party walls, each of which has only one dwelling unit from ground to roof, independent outside access, not more than two walls in common with adjacent units and open space to the front and rear (internal units) or front, rear and one side (end units).
(c) 
APARTMENT—A building containing three or more dwelling units separated by party walls, which may have more than one dwelling unit from ground to roof and common outside access and hallways.
EATING AND DRINKING ESTABLISHMENT
A restaurant or similar establishment offering service to the public, which provides for the sale and consumption of food and beverages and which contains inside seating facilities.

EDUCATIONAL USE
Use of land or a building or buildings as or for an institution not for profit or private college, secondary or elementary school or other educational institution for the academic instruction and cultivation of the mind and/or the inculcation of a clearer sense of moral and spiritual values, not including an institution or organization directed primarily to the physical training or development of physical or manipulative skills, and not to include any organization organized as such solely or primarily for the purpose of evading this chapter. This definition and regulation of educational use to which this definition applies shall not be applicable to the uses or other regulations attendant to the PU Planned University District.

ELECTRICAL TRANSMISSION STRUCTURE
Transmission poles and towers in ROW, easements and electric company property.

EMERGENCY
A condition that:

Constitutes a clear and immediate danger to the health, welfare, or safety of the public; or
(2) 
Has caused or is likely to cause facilities in the rights-of-way to be unusable and result in loss of the services provided.
ENLARGEMENT
An addition to the floor area of an existing building, an increase of size of another structure or an increase in that portion of a lot occupied by an existing use.
ESSENTIALLY DRY SPACE
A space which will remain dry during flooding, except for the passage of some water vapor or minor seepage; the structure is substantially impermeable to the passage of water.

EXISTING MANUFACTURED HOME PARK OR SUBDIVISION
A manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including, at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed before the effective date of the floodplain management regulations adopted by a community.

EXOTIC WILDLIFE
Wild, dangerous and/or exotic nondomesticated animals, including but not limited to bears, coyotes, foxes, raccoons, lions, tigers, wolves, and similar animals, as defined in the Game and Wildlife Code, Act 93 of 1986,[7] or amendments thereof, as "exotic wildlife" or "wildlife."

FLOODPLAIN AREA
A relatively flat or low land area which is subject to partial or complete inundation from an adjoining or nearby stream, river or watercourse; and/or any area subject to the unusual and rapid accumulation of surface waters from any source.

FLOODPROOFING
Any combination of structural and nonstructural additions, changes or adjustments to structures which reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities, structures and their contents.

FLOODWAY
The channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than one foot.

FLOOR AREA
The sum of the area of the several floors of a building or buildings measured from the exterior face of the exterior walls or from center lines of walls separating two buildings. In particular, floor area includes but is not limited to the following:

(1) 
Basement space, if it meets the requirement of a building story.
(2) 
Elevator shafts, stairwells and attic space (whether or not a floor has been laid) providing structural headroom of eight feet or more.

Roofed terraces, exterior balconies, breezeways or porches, provided that over 50% of the perimeter of these is enclosed in such a way as to protect against the elements.
(4) 
Any other floor space for a use permitted by this chapter, not only within a building but also outside a building and accessory to the building use, such as, by way of example, a restaurant outside seating area.

The area of accessory buildings.
FLOOR AREA RATIO
The aggregate floor area, in square feet, of a building or groups of buildings on a lot divided by the gross area, in square feet, of a lot.

FLOOR, LOWEST
The lowest floor of the lowest enclosed area (including basement). An unfinished or flood-resistant enclosure usable solely for parking of vehicles, building access or storage in an area is not considered a building's lowest floor, provided that such an enclosure is not built so as to render the structure in violation of the applicable non-elevation design requirements of the Floodplain District Ordinance.[8]

FOOTCANDLE
A unit of light intensity stated in lumens per square foot and measurable with an illuminance or light meter.

FORESTRY
The management of forests and timberlands when practiced in accordance with accepted silvicultural principles, through developing, cultivating, harvesting, transporting and selling trees for commercial purposes, which does not involve any land development.

FULL CUTOFF
A fixture light-distribution classification, which in a fixture's mounted form does not allow any of the lamp output to be emitted at and above a horizontal plane through the fixture's lowest light-emitting part and does not allow more than 10% of the lamp output to be emitted in the zone between the horizontal plane and a vertical angle of 80° from the outer perimeter of the fixture.

GLARE
The visual sensation produced by a light source, either directly or by reflection, that results in an annoyance, discomfort or loss in visual performance.

GRADE PLANE
A reference plane representing the average of finished ground level adjoining the building at exterior walls. Where the finished ground level slopes away from the exterior walls, the reference plane shall be established by the lowest points within the area between the building and the lot line or, where the lot line is more than six feet from the building, between the building and a point six feet from the building.

GROSS LEASABLE AREA
The total floor area of a building or structure for which a tenant would be charged rent and which is designed for the exclusive use of a tenant or other occupant; excluded are public or common areas, such as stairwells, utility rooms, halls, elevator shafts and interior parking or loading areas.

The point or points where pits, wells or other facilities are placed in a geologic formation at a particular depth or over a particular depth range for the purpose of collecting samples of groundwater from directly beneath the point or points.

HEAVY USE OF WATER
For the purposes of determining impacts to an on-site sewage system for a major home occupation, heavy use of water shall be determined by adding the base sewage rate estimate for a residence of 250 gallons per day to the total sewage flow estimates provided in the Pennsylvania Code, Title 25, Chapter 73.17, for the proposed use(s), or the closest similar use(s). A sum totaling 400 gallons per day or higher shall constitute a use considered a heavy use of water.

HEIGHT OF A TOWER-BASED WCF

HOME OCCUPATION, MAJOR
A home occupation of potentially greater neighborhood impact than a no-impact home-based business, requiring the employment of not more than two persons (full-time or part-time) not residing on the premises, with not more than one unilluminated sign (not exceeding three square feet in area) as visible exterior evidence of the conduct of the occupation, and accommodating both dwelling and home occupation parking needs off street. Examples of major home occupation include babysitters (three through and including five children); dressmaking; millinery; upholstery; furniture refurbishing or similar handicrafts; professional studios or offices of an architect, doctor, dentist, engineer, lawyer, musician, magistrate, photographer or practitioner of similar character; small pet grooming; or other home occupation of similar character and impact.[10]

HOME OCCUPATION SIGN
A sign which identifies or advertises permitted major home occupations.

HOTEL/MOTEL
A building or group of buildings especially designed for the temporary lodging of guests. Such establishment shall furnish to the occupants customary services such as housekeeping and the furnishing and laundering of linen.

IDENTIFICATION SIGN
A sign located on the premises, other than a bulletin board or nameplate sign, indicating the name of a development, the name or address of a building or the name of the management thereof.

IDENTIFIED FLOODPLAIN AREA
An umbrella term that includes all of the areas within which the community has selected to enforce floodplain regulations. It will always include the area identified as the special flood hazard area on the Flood Insurance Rate Maps and Flood Insurance Study but may include additional areas identified by the community. See § 115-42D(1) and (2) for the specifics on what areas the community has included in the identified floodplain area.

IMPROVED SURFACE
A stable all-weather surface to facilitate pedestrian movement constructed of materials including but not limited to concrete, asphalt, brick, pavers, flagstone, or other similar consistent material or construction that provides a safe walking surface and ease of maintenance for activities such as snow shoveling.

INDUSTRIAL WASTE
Any and all waste discharged from an industrial or manufacturing establishment other than domestic waste.

INTERNAL WALKWAY
A designated single-use facility with an improved surface primarily for use by pedestrians, located outside of the road right-of-way and/or not directly adjacent to a street. A walkway is generally used for pedestrian transportation 1) between buildings and parking areas or sidewalks, 2) within parking lots, 3) between buildings on a parcel or within a development, or 4) between adjacent uses, developments, or facilities.

INTERNALLY ILLUMINATED SIGN
A sign which is designed to give forth artificial light directly or through transparent or translucent material from a source of light within or upon said sign.

JUNK
Scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, waste, iron, steel and other old or scrap ferrous or nonferrous material, including wrecked, scrapped, ruined, dismantled, junked or abandoned motor vehicles or parts thereof.

JUNKED OR ABANDONED MOTOR VEHICLES
Includes, but shall not be limited to, one or more of the following:

A vehicle for which a certificate of junk has been issued by the Pennsylvania Secretary of Revenue or the official designated by any other state to issue such certificates.
(2) 
A vehicle in or on which it is found that any of the following exist:

Its engine or engine parts have been removed for more than 90 days.
(b) 
Its tires have been deflated or its wheels have been removed for more than 90 days.
(c) 
It bears no official inspection sticker or any such sticker is not current by more than 90 days, provided that a vehicle under repair which is bona fide intended for use shall not be deemed within the foregoing definition.
JUNKYARD
A lot, land or structure or part thereof used primarily for the collecting, storage, keeping, buying or selling of junk or for the collecting, dismantling, storage or salvaging of machinery or junked or abandoned vehicles or for the sale of the parts thereof. It shall also be construed to include any place where one or more junked or abandoned vehicles is stored.

KENNEL
Any facility which is designed to:

The application of sludge on, under or into the land at any location for any purpose other than agriculture.

LAND DEVELOPMENT
Any of the following activities:

The improvement of one lot or two or more contiguous lots, tracts or parcels of land for any purpose involving:
(a) 
A group of two or more residential or nonresidential buildings, whether proposed initially or cumulatively, or a single nonresidential building on a lot or lots, regardless of the number of occupants or tenure;
(b) 
The division or allocation of land or space, whether initially or cumulatively, between or among two or more existing or prospective occupants by means of or for the purpose of streets, common areas, leaseholds, condominiums, building groups or other features.
(2) 
A subdivision of land. Those activities described in Section 503(1.1) of the Act[11] shall not be considered land developments for purposes of this chapter.
LANDING
A place where logs, pulpwood or firewood are assembled for transportation to processing facilities.

LANDOWNER
The legal or beneficial owner or owners of land, including the holder of an option or contract to purchase, whether or not such option or contract is subject to any condition, a lessee if he is authorized under the lease to exercise the rights of the landowner or other person having a proprietary interest in the land.

LOT
A designated parcel, tract or area of land established by a plat or otherwise as permitted by law and to be used, developed or built upon as a unit, undivided by any street or private road or dedicated future street right-of-way. Such parcel shall be separately described by metes and bounds, the description of which is recorded in the office of the Recorder of Deeds of Chester County by deed description or is described by an approved subdivision plan recorded in the office of the Recorder of Deeds of Chester County, and shall have required frontage on, combined with complete and direct access to, a street with a cartway, existing or proposed. If proposed, the cartway shall be constructed to provide the sole access to the lot.

All area included within the titled lines of a lot, existing or proposed.

Those areas within a floodplain, as defined herein.

Those areas within a floodplain, as defined herein, and/or a watercourse as defined in the Pennsylvania Code, as amended.[13]
(d) 
Those areas comprising stormwater management facilities referred to in § 95-26, Stormwater management, of the Code. In the case of on-lot stormwater management systems serving individual single-family dwellings, this exclusion shall be applicable only to those lots created or altered through subdivision or development approved after the effective date of this amendment.
(e) 
Those areas comprising rights-of-way and easements for aboveground utilities and underground utilities put in for local service.
(f) 
Those areas within wetlands, as defined herein.
LOT, CORNER
A lot bounded on at least two sides by streets whenever the lines of such streets extended from an interior angle of 135° or less. Both yards adjacent to streets shall be considered front yards. The remaining two yards shall be side yards.
LOT CRITERIA
A lot shall contain at minimum a front yard, a side yard and a rear yard unless permitted elsewhere in this chapter.

LOT, INTERIOR
A lot that is connected to a street by an access strip of required minimum width, and where such access strip is contained within and is a part of the same lot. Minimum lot area and other dimensional requirements shall be those of the applicable zoning district and shall be met on that portion of the lot exclusive of the access strip.

LOT, IRREGULAR
A lot, which is comprised of lot lines forming one or more acute angles less than 60°, or a lot comprised of only three angles. Where a lot line connects to a point of curvature, the angle measurement shall be between the lot line and the curve tangent line. An irregular lot shall be prohibited.

LOT LINE, FRONT
The lot line abutting a street, including shared driveways, and coinciding with the street line. In the case of a corner lot, both street abutting lot lines shall be deemed the front lot line. Where the lot is an interior lot, the front lot line shall be the line of the lot nearest and most nearly parallel to the street and shall include, where appropriate, the width of the access strip.

LOT LINE, REAR
A lot line opposite and most distant from the front lot line. If the lot is triangular in shape and forms a single point at the rear, the rear lot line shall be considered the single point where the two side lot lines intersect. The rear yard setback line shall be measured from the point of intersection of the side lot lines, measured perpendicular to the front lot line.

LOT LINE, SIDE
Any lot line which is not a front lot line nor a rear lot line.
LOT OR TRACT COVERAGE
The percentage of gross lot or gross tract area covered by any and all impervious materials, such as buildings, paved parking areas, paved walks, terraces and similar surfaces which do not normally absorb rainfall. Impervious materials as described herein shall include any artificial turf surfaces and stoned surfaces.

LOT, REVERSE FRONTAGE
A lot extending between and having frontage on an arterial or collector street and an interior residential street, with vehicular access solely from the interior residential street. Such access shall be by use of an individual, nonshared driveway.

LOT SIZE, GROSS

LOT WIDTH
The horizontal distance between side lot lines, measured along the street line or building setback line as specified. When the street line is curved, the measurement shall be made on the arc on or parallel to the curve of the street line.

LOWEST FLOOR
The lowest floor of the lowest fully enclosed area (including basement). An unfinished, flood-resistant, partially enclosed area used solely for parking of vehicles, building access and incidental storage in an area other than a basement area is not considered the lowest floor of a building, provided that such space is not designed and built so that the structure is in violation of the applicable nonelevation design requirements of this chapter.

A structure, transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when attached to the required utilities. The term includes park trailers, travel trailers, recreational and other similar vehicles which are placed on a site for more than 180 consecutive days.

MANUFACTURED HOME PARK OR SUBDIVISION
A parcel (or contiguous parcels) of land divided into two or more manufactured home lots for rent or sale.

MINERALS
Any aggregate or mass of mineral matter, whether or not coherent. The term includes, but is not limited to, limestone and dolomite, sand and gravel, rock and stone, earth, fill slag, iron ore, zinc ore, vermiculite and clay, anthracite and bituminous coal, coal refuse, peat and crude oil and natural gas.

MINERAL EXTRACTION
The excavation, harvesting or removal by any means of any type of Minerals for commercial purposes, which does not involve any land development.

MINIMIZE
To reduce to the smallest amount possible. Minimize shall not mean complete elimination but shall require that the most substantial efforts possible under the circumstances have been taken to reduce the adverse effect of the action required to be minimized. With respect to activities, the conduct of which is adverse to the preservation of the natural features of land, the requirement to minimize shall include but not be limited to the requirement that the placement of dwellings and other structures and the location of roads, sedimentation and erosion control devices and earthmoving activities shall be planned and designed so as to permit the adverse effect of the activity in question to be reduced to the smallest amount under the circumstances consistent with the otherwise permitted development.

MINOR REPAIR
The replacement of existing work with equivalent materials for the purpose of its routine maintenance and upkeep but not including the cutting away of any wall, partition or portion thereof, the removal or cutting of any structural beam or bearing support or the removal or change of any required means of egress or rearrangement of parts of a structure affecting the exitway requirements; nor shall minor repairs include addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer, drainage, drain leader, gas, oil, waste, vent, or similar piping, electrical wiring or mechanical or other work affecting public health or general safety.

MOBILE HOME
A transportable, single-family dwelling, intended for permanent occupancy, contained in one unit or in two or more units designed to be jointed into one integral unit capable of again being separated for repeated towing, which arrives at a site complete and ready for occupancy, except for minor and incidental unpacking and assembly operations, and constructed so that it may be used without a permanent foundation, including any addition or accessory structure, such as porches, sheds, decks or additional rooms.

MOBILE HOME LOT OR SITE
A parcel of land in a mobile home park, improved with the necessary utility connections and other appurtenances necessary for the erection thereon of a single mobile home, which is leased by the park owner to the owner or occupants of the mobile home erected on the lot.

MOBILE HOME PAD
A concrete pad, at least six inches in thickness, with at least six tie-down rings to which the mobile home shall be secured, equal in length and width to the dimensions of the mobile home to be placed thereon.

MOBILE HOME PARK
A parcel or contiguous parcels of land which have been so designated and improved that they contain two or more mobile home lots for the placement thereon of mobile homes.

MONOPOLE
A WCF or site which consists of a single pole structure, designed and erected on the ground or on top of a structure, to support communications antennas and connecting appurtenances.

A tract of land developed for or intended to be developed for buildings, structures and infrastructure maintained by the Township of East Bradford to govern and provide services to the public.

NET TRACT AREA
For purposes of establishing the maximum permissible number of lots or dwelling units on any tract, the net tract area shall include all areas within the titled lines of a tract, excluding the following:

Those areas within a floodplain, as defined herein, or as defined by the Pennsylvania law or regulation where the waterway is an unstudied stream.
(4) 
Those areas comprising stormwater management basins, basin easements or stormwater drainage easements referred to in § 95-26, Stormwater management, of the Code; any area within the Floodplain District as established in § 115-42.
(5) 
Those areas comprising rights-of-way and easements for above-ground utilities and underground utilities other than for local service.

NEW CONSTRUCTION
Structures for which the start of construction commenced on or after the effective start date of this Floodplain Management Ordinance[14] and includes any subsequent improvements to such structures. Any construction started after April 15, 1977, and before the effective start date of this Floodplain Management Ordinance is subject to the ordinance in effect at the time the permit was issued, provided that the start of construction was within 180 days of permit issuance.

NEW MANUFACTURED HOME PARK OR SUBDIVISION
A manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed on or after the effective date of floodplain management regulations adopted by a community.

NO-IMPACT HOME-BASED BUSINESS
A business or commercial activity administered or conducted as an accessory use which is clearly secondary to the use as a residential dwelling which involves no customer, client or patient traffic, whether vehicular or pedestrian, pickup, delivery or removal functions to or from the premises, in excess of those normally associated with residential use. The business or commercial activity must satisfy the following requirements:

(1) 
The business activity shall be compatible with the residential use of the property and surrounding residential uses.
(2) 
The business shall employ no employees other than family members residing in the dwelling.
(3) 
There shall be no display or sale of retail goods and no stockpiling or inventory of a substantial nature.
(4) 
There shall be no outside appearance of a business use, including, but not limited to, parking, signs or lights.
(5) 
The business activity may not use any equipment or process which creates noise, vibration, glare, fumes, odors or electrical or electronic interference, including interference with radio or television reception, which is detectible in the neighborhood.
(6) 
The business activity may not generate any solid waste or sewage discharge, in volume or type, which is not normally associated with residential use in the neighborhood.
(7) 
The business activity shall be conducted only within the dwelling and may not occupy more than 25% of the habitable floor area.
(8) 
The business may not involve any illegal activity.
NONCONFORMING LOT
A lot, the area or dimension of which was lawful prior to the adoption or amendment of a zoning ordinance or portion thereof, but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption or amendment.

NONCONFORMING STRUCTURE
A structure or part of a structure manifestly not designed to comply with the applicable use or extent of use provisions in this chapter or amendment thereto where such structure lawfully existed prior to the enactment of this chapter or amendment thereto. Such nonconforming structures include, but are not limited to, nonconforming signs.

NONCONFORMING USE
A use, whether of land or of a structure, which does not comply with the applicable use provisions of this chapter or amendment thereto, where such use was lawfully in existence prior to the enactment of this chapter or amendment thereto.
NON-TOWER WIRELESS COMMUNICATIONS FACILITY (NON-TOWER WCF)
All non-tower wireless communications facilities, including but not limited to, antennas and related equipment. Non-tower WCF shall not include support structures for antennas or any related equipment that is mounted to the ground or at ground level.

NORMAL FARMING OPERATIONS
The activities, practices, equipment and procedures that farmers adopt, use or engage in the production and preparation for market of fowl, livestock and their products and in the production, harvesting and preparation for market or use of agricultural, agronomic, horticultural, silvicultural and aquacultural crops and commodities and is:

Not less than 10 contiguous acres in area; or
(2)

NO-TRESPASSING SIGN
A sign indicating the private nature of property, a road or driveway or a sign restricting or prohibiting access, hunting, fishing or some other activity.

NURSING HOME
A facility providing nursing services on a continuing basis and which admits the majority of the occupants, upon advice of physician, as ill or infirm persons requiring nursing services and provides for physicians' services or supervision and maintains medical records, including also provisions for other and similar medical or nursing services. Care for the acutely ill or surgical or obstetrical services shall not be considered similar services under this definition, nor shall hospitals be included in this definition.

OBJECT
A thing of functional, aesthetic, cultural, historical or scientific value that may be, by nature or design, movable yet related to a specific setting or environment.

OFFICIAL MAP AND ORDINANCE, AS AMENDED
An independent map and ordinance enabled by the Pennsylvania Municipalities Planning Code (MPC)[15] that may identify public facilities, including but not limited to parks, trails, areas of open space, recreation, utilities, and other similar facilities. The Official Map gives the municipality the first right of refusal to purchase land necessary to facilitate the identified public improvement(s) and may delay a development for up to one year.

The disposal of sewage by use of a sanitary sewer system served by a central sewage treatment plant approved by the Chester County Health Department and the Pennsylvania Department of Environmental Protection.

OFF-SITE WATER SERVICE
A safe, adequate and healthful supply of water to more than one user from a common source approved by the Pennsylvania Department of Environmental Protection.

ONE-HUNDRED-YEAR FLOOD
A flood that on the average is likely to occur once every one hundred years (i.e., that has a one-percent chance of occurring each year, although the flood may occur in any year).

ON-SITE SEWER SERVICE
The disposal of sewage by use of cesspools, septic tanks or other safe and healthful means within the confines of the lot on which the use is located as approved by the Chester County Health Department.
ON-SITE WATER SERVICE
A safe, adequate and healthful supply of water to a single user from a private well.
OPEN SPACE
Except where modified by § 115-148A(2)(d), a contiguous area of land, with a boundary common to the land development it is provided for (which shall not be a street), permanently restricted against further development and alteration, used for year-round common enjoyment and recreation by residents of a development and possibly the general public, held in common ownership and managed in accordance with § 115-50 by the residents of a homeowners' association established as part of the proposed land development. All open space shall be accessible and usable by members of the homeowners' association and possibly the general public, and shall exclude area covered by buildings and land within 35 feet of a building, impervious surfaces (as defined in "lot or tract coverage" except as noted below), rights-of-way, private yards, required yard setbacks, utility or storm drainage easements, public facilities, such as schools and churches, sewage treatment and disposal areas and any other areas specified in § 115-49, but including impervious surfaces and structures associated with recreational site improvements, such as bicycle and walking trails, game courts, gazebos, etc.

OPEN SPACE DEVELOPMENT OPTION
A development design option which allows the minimum lot area and yard requirements to be reduced so that buildings and lots can be grouped together in a more efficient and environmentally sensitive configuration, provided that the remaining area is set aside and preserved as common open space.

SANITARY LANDFILL
A lot or portion of a lot used for deposit and storage of refuse and in which all exposed refuse is covered daily with a minimum of six inches of earth. A sanitary landfill shall be operated in accordance with standards established by, and shall be subject to inspection by, the Pennsylvania Department of Environmental Protection or Chester County Department of Health, or it shall be considered a dump.

SELECTIVE CUTTING
The felling of certain, but not all, trees in an area for the purposes of:
(1) 
Removing dead, diseased, damaged, mature or marketable timber;
(2) 
Improving the quality of a tree stand or species; or

Meeting personal domestic needs.

SEWAGE DISPOSAL, CENTRAL/COMMUNITY COLLECTION AND TREATMENT (CENTRALIZED)
A sanitary sewage system which carries sewage from individual dischargers by a system of pipes to one or more common treatment and disposal facilities, either on site or off site, and approved by the Pennsylvania Department of Environmental Protection. Any such system must be approved pursuant to a revision to the Township's Act 537 Plan or any other required federal, state or local review process.

SEWAGE DISPOSAL, INDIVIDUAL
The disposal of sewage from one use or dwelling unit by use of septic tanks or other safe and healthful means, approved by the Chester County Health Department. Such system shall be totally within the confines of the lot on which the use is located.

SEWAGE DISPOSAL, PUBLIC SEWAGE SYSTEM (CENTRALIZED)
An off-site system for treatment and disposal of sewage in which sewage is conveyed by interceptor to the treatment facility operated by a municipal entity, and disposed of through means approved by the Pennsylvania Department of Environmental Protection.

SEWAGE SLUDGE

Supplemental signage added to a shared roadway to warn motorists of the increased likelihood of bicyclists.

SHARED ROADWAY - LIMITED OR NO SHOULDER
A street which accommodates bicyclists and motorists in the same travel lane. The travel lanes are wider than what would be designed for vehicular traffic for the associated functional classification of the road and its context. Shared roadways may be a signed bike route or include other indicators such as Share the Road signs, sharrows, other pavement markings, or signage.

SHOPPING CENTER
The multiple use of a single property for the retail sale of such things as dry goods, variety and general merchandise, clothing, food, flowers, drugs, household supplies or furnishings; the sale or repair of jewelry, watches and clocks, optical goods or musical, professional or scientific instruments; the provision of personal services such as barbershops, banks, hairdressers, laundry or laundromats and cleaning and pressing shops; and for such purposes as theaters or bowling alleys.
SIDEWALK
A pedestrian route, constructed in accordance with § 95-24 of the Township Code, adjacent to a street that provides a means for pedestrians to travel within the public right-of-way while physically separated from vehicular traffic. Sidewalks are designed for pedestrian use.

(1) 
Wireless communication facilities (WCF) that meet each of the following conditions:
(a) 
The facilities:
[1] 
Are mounted on structures 50 feet or less in height, including their antennas; or
[2] 
Are mounted on structures no more than 10% taller than other adjacent structures; or
[3] 
Do not extend the existing structures on which they are located to a height more than 50 feet or by more than 10%, whichever is greater;
(b) 
Each antenna associated with the deployment, excluding associated antenna equipment, is no more than three cubic feet in volume;
(c) 
All other wireless equipment associated with the structure, including the wireless equipment associated with the antenna and any pre-existing associated equipment with the structure, is no more than 28 cubic feet in volume;
(d) 
The facilities do not require antenna structure registration under law;
(e) 
The facilities are not located on tribal land, as defined by law; and
(f) 
The facilities do not result in human exposure to radiofrequency radiation in excess of applicable safety standards.

SWFs may be tower based or non-tower based.

START OF CONSTRUCTION
Includes substantial improvement and other proposed new development and means the date the permit was issued, provided that the actual start of construction, repair, reconstruction, rehabilitation, addition, placement, or other improvement was within 180 days after the date of the permit and shall be completed within 12 months after the date of issuance of the permit unless a time extension is granted, in writing, by the Floodplain Administrator. The "actual start" means either the first placement of permanent construction of a structure on a site, such as the pouring of slab or footings, the installation of piles, the construction of columns, or any work beyond the stage of excavation, or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading, and filling; nor does it include the installation of streets and walkways; nor does it include excavation for a basement, footings, piers, or foundations or the erection of temporary forms; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure. For a substantial improvement, the actual start of construction means the first alteration of any wall, ceiling, floor, or other structural part of a building, whether or not that alteration affects the external dimensions of the building.

STEALTH TECHNOLOGY
Camouflaging methods applied to wireless communications towers, antennas and other facilities which render them more visually appealing or blend the proposed facility into the existing structure or visual backdrop in such a manner as to render it minimally visible to the casual observer. Such methods include, but are not limited to, architecturally screened roof-mounted antennas, building-mounted antennas painted to match the existing structure and facilities constructed to resemble trees, shrubs, and light poles.

STORY
That portion of a building included between the upper surface of a floor and the upper surface of the floor or roof next above. It is measured as the vertical distance from top to top of two successive tiers of beams or finished floor surfaces and, for the topmost story, from the top of the floor finish to the top of the ceiling joists or, where there is not a ceiling, to the top of the roof rafters.

STORY ABOVE GRADE PLANE
Any story having its finished floor surface entirely above grade plane, or in which the finished surface of the floor next above is:

More than six feet above grade plane; or

STREAM
Any natural or artificial channel of conveyance for surface water with an annual or intermittent flow within a defined bed and banks.

STREET
A right-of-way intended for the general public use to provide means of approach for vehicles and pedestrians. The word “street” includes the words “roads,” “highway,” “thoroughfare” and “way.” The Roadway Classification Map contained in the East Bradford Township Comprehensive Plan, as amended, and the East Bradford Township Scenic Road Ordinance, as amended, shall control the classification of individual streets as to the street types defined herein.

(1) 
ARTERIAL—A street serving a large volume of comparatively high-speed and long-distance traffic, including all facilities classified as main and secondary highways by the Pennsylvania Department of Transportation.
(a) 
MAJOR—An arterial serving the heaviest volumes of traffic in the Township and providing the highest degree of vehicular mobility. By way of example, Route 322 is designated a major arterial.
(b) 
MINOR—An arterial serving relatively heavy volumes of traffic and providing a high degree of mobility. By way of example, Route 52 and Strasburg Road are designated as minor arterials.
(2) 
COLLECTOR—A street designed and located to:
(a) 
Drain traffic from local streets;
(b) 
Provide access for through traffic between residential neighborhoods and districts within the Township and to arterials; and/or
(c) 
Provide access to nonresidential properties, i.e., commercial, industrial, professional, etc.
(3) 
INTERIOR RESIDENTIAL STREET—A street serving a residential development or neighborhood, intended to provide access to the properties abutting thereon and not connecting with other streets in such a manner as to encourage through traffic.
(4) 
CUL-DE-SAC STREET—An interior residential street intersecting another street at one end and terminating at the other end in a permanent vehicular turnaround.
(5) 
SINGLE-ACCESS STREET—An interior residential street or streets, including but not limited to cul-de-sac and loop designs, which has only one point of intersection with an existing Township or state road or with a proposed road having more than one access point. A single-access street which is constructed as a boulevard at its intersection with an existing Township or state road shall be deemed to have only one point of intersection.

(6) 
MARGINAL ACCESS STREET—A street, parallel and adjacent to an arterial or collector street (but separated from it by a reserve strip), which provides access to abutting properties and controls intersections with major streets.
(7) 
PRIVATE STREET—A street, serving only abutting lots, that is not offered or required to be offered for dedication.
(8) 
BOULEVARD—A street which has one or more lanes of travel in one direction separated by a landscaped area, barrier or other separation from one or more lanes of travel in the opposite direction.

(9) 
SCENIC ROADS—Certain streets as defined by the East Bradford Township Scenic Road Ordinance, as amended from time to time, or other applicable ordinance as adopted from time to time.
STREET, CENTER LINE OF
A line which is an equal distance from both street lines.
STREET LINE
The right-of-way line of a street.
STRUCTURE
Any form or arrangement of building materials involving the necessity of providing proper support, bracing, typing and anchoring to a fixed location on or below the surface of the ground, including but not limited to buildings, sheds, decks, mobile or manufactured homes and other similar items. This term includes any man-made object having an ascertainable stationary location on or in land or water, whether or not affixed to the land; within any floodplain district this term also includes a walled or roofed building including a gas or liquid storage tank that is principally above the ground, as well as a manufactured home.

STUDENT HOUSING
Living accommodations for university students, faculty, staff and guests participating in university events, constructed as dormitories or as apartment buildings.

SUBDIVISION
The division or redivision of a lot, tract or parcel of land by any means into two or more lots, tracts, parcels or other divisions of land, including changes in existing lot lines, for the purpose, whether immediate or future, of lease, partition by the court for distribution to heirs or devisees, transfer of ownership or building or lot development; provided, however, that the subdivision by lease of land for agricultural purposes into parcels of more than 10 acres, not involving any new street or easement of access or residential dwellings, shall be exempted.

(1) 
The creation of a mortgage encumbering real estate is a subdivision if it encumbers less than the entire tract of land filed in the mortgagor's name at the time the mortgage is created.

The term "subdivision" includes resubdivision and, as appropriate in this chapter, shall refer to the process of subdividing land or to the land subdivided.
SUBSTANTIAL DAMAGE
Damage of any origin sustained by a structure whereby the cost of restoring the structure to its before-damaged condition would equal or exceed 50% of the market value of the structure before the damage occurred.

SUBSTANTIAL IMPROVEMENT
Any reconstruction, rehabilitation, addition, or other improvement of a structure, of which the cost equals or exceeds 50% of the market value of the structure before the "start of construction" of the improvement. This term includes structures which have incurred substantial damage or cumulative substantial damage regardless of the actual repair work performed. The term does not, however, include any project for improvement of a structure to correct existing violations of state or local health, sanitary, or safety code specifications which have been identified by the local code enforcement official and which are the minimum necessary to assure safe living conditions.

SUBSTANTIALLY CHANGE

Any increase in the height of a wireless support structure by more than 10%, or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed 20 feet, whichever is greater, except that the mounting of the proposed wireless communications facility may exceed the size limits set forth in the East Bradford Township Zoning Code or the WBCA if necessary to avoid interference with existing antennas; or
(2) 
Any further increase in the height of a wireless support structure which has already been extended by more than 10% of its originally approved height or by the height of one additional antenna array.
SURFACE LAND USES AFFILIATED WITH TRANSMISSION PIPELINES
Aboveground transmission pipeline facilities including, but not limited to, compressor stations, pumping stations, regulator stations, launcher/receiver stations, and other surface pipeline appurtenances.

TEMPORARY SIGN
A sign which is constructed of cloth, paper, cardboard or any material other than glass, wood or metal, intended to be displayed for a short time only, including banners, pennants, advertising flags and poster placards.

An analysis of the effect of all modes of transportation generated by a development on the capacity, operations, and safety of the public street and highway system. The TIS is used to determine the improvements that are necessary to ensure that the transportation network can accommodate the new development.

TREE PROTECTION ZONE
An area surrounding a tree or tree mass in which no construction, construction activity or other disturbance shall take place.

WIRELESS COMMUNICATIONS FACILITY (WCF)
The antennas, nodes, control boxes, towers, poles, conduits, ducts, pedestals, electronics and other equipment used for the purpose of transmitting, receiving, distributing, providing, or accommodating wireless communications services.

WIRELESS COMMUNICATIONS FACILITY APPLICANT (WCF APPLICANT)
Any person that applies for a wireless communication facility building permit, zoning approval and/or permission to use the public right-of-way (ROW) or other Township-owned land or property.

WIRELESS SUPPORT STRUCTURE
A freestanding structure, such as a tower-based wireless communications facility or any other support structure that could support the placement or installation of a wireless communications facility if approved by the Township.

WOODLAND
A plant community of 1/4 acre or larger in area, composed predominantly of healthy trees, six inches and greater in diameter dbh, and other woody vegetation, growing more or less closely together, the branches of which form a complete or nearly complete aerial canopy. For the purposes of this chapter, the extent of any woodland shall be measured from the outermost dripline of all the trees in the community.

WOODLAND MANAGEMENT PLAN
A description, by means of text and maps, of proposed actions involving the removal of trees from a tract of land. Such plan shall be prepared by a person(s) with demonstrable expertise in forest management and shall document measures to be taken to protect water quality, to minimize impacts from skid trails and logging roads, landing areas and the tree removal process and to assure site restoration.

That portion of a lot which is unoccupied and open to the sky and extends from the lot line to the structure.

A yard extending the full length of the lot along a side lot line and extending in width from such side lot line to the nearest point of any building on the lot.
