Adequate and safe access along all sidewalks must be maintained at all times for use by the public. However, when a property is under new construction, or a major renovation or alteration is underway, and the sidewalk is to be replaced, it must remain until ready to be immediately replaced. The contractor or owner shall obtain a permit from the construction office, or if the sidewalk replacement is covered under the original construction permit, the contractor or owner shall obtain a written notice to proceed from the construction office, before the sidewalk is replaced. The contractor or owner shall then have five days from the date of the issuance of the permit or the notice to proceed, to complete the replacement of the sidewalk.
During the five-day period for the removal and reconstruction of the sidewalk, the contractor or owner shall post a sign at the site warning the public of the danger, and the sidewalk area shall be blocked off to prevent pedestrian access.
The five-day time period may be extended by the construction office, in it's discretion, where adverse weather conditions have hampered the sidewalk replacement.
The above requirements calling for a construction permit, notice to proceed, five days to complete, warning sign, and blocking off to the sidewalk shall be applicable any time a sidewalk is being replaced, whether or not other construction is taking place.
Any person violating the provisions of this article shall, upon conviction, be subject to the penalties set forth in Chapter 1, Article III, Penalty, of the Borough of Stone Harbor Code.
