It shall be unlawful for any person, within the confines of any Borough-owned building or Borough-owned vehicle, to smoke any tobacco product, including, but not limited to, cigarettes, cigars and pipes.
To ensure that all Borough employees and other persons have been adequately notified of this prohibition, the provisions of this chapter shall not be effective until signs clearly designating "No Smoking" in the building are prominently displayed near the entrance to each building and in other areas as determined by the Borough Council or the Borough Administrator from time to time. Nor shall this chapter be effective until notification of the chapter has been prominently displayed on the Clerk's bulletin board, in the public works building, the police building and all other Borough-owned buildings where Borough employees work.
Any person accused of a violation of this chapter shall be given a written warning for the first accusation. Thereafter, any such person accused a second time shall be charged with a violation of this chapter and upon conviction thereof, shall be subject to a fine of at least $25, but no more than the penalties set forth in Chapter 1, Article III, Penalty, of the Borough of Stone Harbor Code.
