A.
The purpose of this chapter is to increase the participation of the residents of the Town in the planning and zoning process by reducing the terms of office of the members of the Planning Board and Zoning Board of Appeals. The Town Board finds that the existing seven-year term of office for the Planning Board and the existing five-year term of office for the Zoning Board of Appeals shall be reduced to three years upon the expiration of each current term of each Board member.
B.
This chapter expressly supersedes the existing provisions of the New York State Town Law § 267(1) last amended by Chapter 913 of the Laws of 1956 and the new § 267(4) of the Town Law to be effective July 1, 1992, as amended by Chapter 692 of the Law of 1991, and the provisions of the New York State Town Law § 271(1) last amended by Chapter 230 of the Laws of 1963 as those provisions relate to the length of the terms of office of the respective Board members. The supersession authority is found at Municipal Home Rule Law § 10, subparagraph (1) subsections (a)(1) and (d)(3). The general authority of the Town of Montgomery to adopt this chapter is found also at Article IX, Section 2, of the New York State Constitution, the Statute of Local Governments, Article 2 of the Municipal Home Rule Law and under the general police power of the Town of Montgomery.
C.
