It shall be the duty of any owner, lessee or occupant of any lot or land to cut and remove or cause to be cut and removed all such weeds, grass, brush or other rank, poisonous or harmful vegetation as often as may be necessary to comply with the provisions of §
87-1, provided that cutting and removing such weeds, grass, brush and vegetation at least once every month from May to October, inclusive, shall be determined to be a compliance with the provisions of §
87-1 and this section.

If the person upon whom the notice is served
fails, neglects or refuses to comply with said notice within five
days after the service of such notice, the Superintendent of Public
Works shall cause such weeds, grass, brush or other vegetation on
such lot or land to be cut and removed, and all expenses incurred
in such work shall be certified by the Superintendent of Public Works
to the Village Treasurer and shall thereupon become and be a lien
upon the property on which such work was performed and shall be added
to and become a part of the taxes next to be assessed and levied upon
such lot or land and shall bear interest at the same rates as taxes
and shall be collected and enforced by the same officer and in the
same manner as taxes.

Any violation of any provisions of this chapter
shall be punishable by a maximum fine of $250 or a term of imprisonment
not to exceed 15 days, or both. Each week's continued violation shall
constitute a separate, additional violation for which no further notice
of any kind needs to be filed or served.

Where the real property was subject to a previous proceeding
under this chapter relative to a same or a similar violation within
120 days prior to the recurrence of the violation, then the Village
may cause the violation to be abated or order the owner to correct
the violation within a period of time not to exceed three days, and,
upon failure to do so, the condition may be abated pursuant to and
subject to the provisions of this chapter.
