There is created a Planning Commission, which shall consist of seven
members appointed by the Mayor subject to the approval of the Village Board
of Trustees, including the Mayor. The present members shall continue in office
until the expiration of their respective terms. At the expiration of such
terms, the terms of office of their successors shall be for three years, and
all appointments to fill vacancies shall be for the unexpired term.
The Planning Commission shall cooperate with the Westchester County
Department of Planning.
The following matters shall be referred, for report thereon, to the
Planning Commission by the board, agency or public officer of the village
which is the final authority thereon before final action thereon by such authority:
A. The adoption of any map or plan pertaining to the zoning
or the development of the village or part thereof, including drainage and
sewer or water system plans or maps.
B. Any change of such maps or plans.
C. The location of any public building, bridge, statute
or monument, highway, park, parkway, square, playground or recreation ground
or public open place of the village.
The Planning Commission shall report, in writing, to the board, agency or public officer of the village concerning each matter referred to it by such board, agency or public officer pursuant to §
25-3 within 45 days from the date such matter was referred to the Planning Commission, and in default of such report within such forty-five-day period, the Planning Commission shall be deemed to have approved the matter so referred to it.
The Planning Commission, created under and pursuant to the provisions
of Article 12-A of the General Municipal Law, shall continue and shall have
the powers and be subject to the restrictions set forth in such article and
shall also have the powers and duties specified for a Planning Board under
the provisions of § 7-718 of the Village Law in addition to the
powers and duties set forth in Article 12-A of the General Municipal Law;
provided, however, that § 238 of the General Municipal Law shall
not be in force.
