A. 
Pursuant to the provisions of § 267 of the Town Law, a Zoning Board of Appeals is hereby created and is referred to in this chapter as the "Zoning Board of Appeals." Said Zoning Board of Appeals shall consist of five members and one alternate to be appointed by the Town Board, which shall also designate one of the members as Chairman thereof, and for such term as provided by the Town Law and any amendments thereto.

B. 
The Zoning Board of Appeals shall have all the powers and perform all the duties prescribed by statute and by this chapter. The Zoning Board of Appeals shall establish such rules and regulations as are necessary for the transaction of its business and as are not inconsistent with the terms and provisions of this chapter, and the Board may amend, modify and repeal the same.

Pursuant to § 271 of the Town Law, a Planning Board of the Town is hereby created and is referred to in this chapter as the "Planning Board." The Planning Board shall consist of five members and one alternate member appointed by the Town Board, which shall also designate one of the members as Chairman thereof, and for such term as provided by the Town Law. The Planning Board shall have all the powers and perform all the duties prescribed by statute and by this chapter. The Planning Board may, pursuant to § 271 of the Town Law, establish such rules and regulations as are necessary for the transaction of its business and as are not inconsistent with the terms and provisions of this chapter. Pursuant to Town Law § 274-a, the Planning Board is hereby authorized to conduct site plan review of uses specified in this chapter.
