No one shall consume an alcoholic beverage or have an open or unsealed
container of an alcoholic beverage in a public place.
As used in this chapter, the following terms shall have the meanings
indicated:
CONTAINER
Anything capable of holding an alcoholic beverage, whether it is
the bottle or can in which the beverage was originally marketed or a bag or
other carrying device.
PUBLIC PLACE
A park, beach, street, parking area or other property in the village
owned by the village, a town, Suffolk County or the State of New York.
This chapter does not apply to persons who consume or possess an alcoholic
beverage in a public place if a license or permit has been obtained in advance
under laws or regulations of the village or the State of New York.
A person who violates this chapter may be subject to a fine of up to
one hundred fifty dollars ($150.) and imprisonment for up to ten (10) days
in jail for a first offense and a fine of up to five hundred dollars ($500.)
and imprisonment for up to thirty (30) days for a second offense.
