It is hereby declared to be the policy of the
Village of Manlius that the subdivision and development of land for
residential, commercial and industrial and other purposes shall be
guided and regulated in such a manner as to meet the following requirements
for orderly and harmonious growth. Land to be subdivided or developed
shall be of such character that it can be used safely without danger
to health; or peril from fire, flood or erosion; excessive noise or
smoke; or other menace. Proper provisions shall be made for drainage,
water supply, sewage disposal and other appropriate utility services.
The proposed streets shall provide a safe, convenient and functional
system for vehicular circulation and shall be properly related to
the Master Plan of the area. Streets shall be of such width, grade
and location as to accommodate prospective traffic as determined by
existing and probable future land and building uses. Buildings, lots,
blocks and streets shall be properly constructed in accordance with
all applicable codes and shall be so arranged as to afford adequate
light and air, to facilitate fire protection and to provide ample
access to buildings for fire-fighting equipment. Land shall be subdivided
or developed with due regard to topography so that the natural beauty
of the land and vegetation shall be protected and enhanced. Adequate
sites for schools, parks, playgrounds and other community services
shall be located so that residents of all neighborhoods shall have
convenient access to such facilities.
For the purpose of these regulations, certain
words used herein are defined as follows:
APPLICATION
A written application to the Planning Board for subdivision
approval on a form prescribed by the Village.
FINAL PLAT
A drawing and related information, in final form, showing
a proposed subdivision and containing all information or detail required
by Article 7 of the Village Law, by these regulations and by any other
applicable state or local law, ordinance, rule, regulation or resolution.
If a preliminary plat is approved as a conditionally approved preliminary
plat, the "final plat" shall include such modifications as were specified
in such conditionally approved preliminary plat.
MASTER PLAN
A comprehensive plan, if any, adopted by the Village pursuant
to § 7-722 of the Village Law, which includes any unit or
part of such plan separately adopted and any amendment to such plan
or parts thereof. The Master Plan and all modifications thereof shall
be on file in the office of the Village Clerk.
OFFICIAL MAP
The map, if any, established by the Village Board pursuant
to § 7-724 of the Village Law, showing streets, highways,
parks and drainage, both existing and proposed.
PRELIMINARY PLAT
A drawing showing the salient features of a proposed subdivision
submitted to the Planning Board for purposes of consideration prior
to submission of the final plat.
REGULATIONS
The subdivision regulations of the Village.
SKETCH PLAN
A sketch of a proposed subdivision showing the information specified in §
87-4 of these regulations to enable the subdivider to save time and expense in reaching general agreement with the Planning Board as to the form of the layout and objectives of these regulations.
SUBDIVIDER
The owner of the land proposed to be subdivided or his or
her agent.
SUBDIVISION
The division of any parcel of land into two or more lots,
blocks or sites, with or without streets or highways. The term "subdivision"
includes resubdivision.
SUBDIVISION, MAJOR
Any subdivision not classified as a minor subdivision, including
but not limited to subdivisions of five or more lots, or any size
subdivision requiring any new street or extension of municipal facilities.
SUBDIVISION, MINOR
Any subdivision containing not more than four lots fronting
on an existing street, not involving any new street or road or extension
of municipal facilities and not adversely affecting the development
of the remainder of the parcel or adjoining property and not in conflict
with any provision or portion of the Master Plan, Official Map, Zoning
Code or these regulations.
VILLAGE
The Village of Manlius, New York.
VILLAGE CODE
The Code of the Village, as amended from time to time.
VILLAGE ENGINEER
The duly designated engineer of the Village or, as the case
may be, the planning consultant or engineer employed by or assigned
to the Planning Board by the Village Board.
