This chapter shall be known as the "Sales Ordinance."
As used in this chapter, the following terms
shall have the meanings indicated:
Public Sale
Includes sales presently referred to as "garage sales" as
well as the hawking, peddling, vending, selling or otherwise disposing
of any goods, wares or merchandise of any description, except meats,
fish, fruits, farm produce and dairy products, and shall include the
business, on a permanent or casual basis, of hawking or peddling any
goods, wares and merchandise of any description from any wagon, cart,
car or other vehicle in any public or private street or place in the
Village of Sands Point.
No auction or public sale shall be held in the
village without compliance with the following conditions:
A. An application for a permit must be submitted to the
Village Clerk in writing at least 10 days prior to the holding of
any such sale of the resident owners of the personal property to be
sold. Such permit shall be valid for two days and only one permit
may be issued per year by the Clerk. If additional permits are requested
within the one year, application for all permits shall be made to
the Board of Trustees.

B. The cost of such permit shall be as provided in Chapter
82, Fees and Deposits, for the holding of an auction sale and for holding of a public sale other than an auction sale, including the day of inspection, if any. Annual fees as shall be determined by the Board of Trustees may be established for public sales which are conducted on a permanent basis permitting the hawking or peddling of any goods, wares and merchandise of any description from a wagon, cart, car or other vehicle in any public or private street or place in the Village of Sands Point.

C. No sale shall, except from a wagon, cart, car or other
vehicle, be held for more than two consecutive days, nor shall there
be more than one day of inspection. The day or days of sale and/or
inspection shall be limited to the hours from 10:00 a.m. to 4:00 p.m.
D. Parking shall be limited to the premises on which
the sale is held unless other arrangements are approved by the Village
Clerk and the Chief of Police. A parking permit must be obtained from
the Police Department prior to the sale.

E. The size and number of signs, directional and otherwise, shall comply with the present sign regulation in § 176-48.1C(4) of Chapter
176, Zoning, or as otherwise prescribed by the Board of Trustees. They shall not be erected before the date of inspection, if any, or the first day of the sale and shall be removed by no later than 6:00 p.m. on the last day of the sale.

F. There shall be no loudspeakers permitted other than
a single loudspeaker for purposes of conducting an auction sale, and
the volume thereof shall not reach beyond the audience.
G. The sale of any property by auction or public sale
shall be limited solely to property owned by the resident-applicant.
H. A public sale other than an auction sale on any given
premises may be held no more often than once every five years and
no more than once by an individual during the period of his ownership
of the real property on which the sale is located, if said ownership
should last less than five years.
I. An auction sale shall be held no more than once by
any individual during the period of his ownership of the real property
on which the sale is located.
Every licensee conducting any sale hereunder
shall keep the village license displayed in a conspicuous place at
the place of sale or on such vehicle used in such business.

Any person violating any provision of this chapter
shall be subject to a fine of $250, and in addition thereto such violation
shall constitute and is hereby declared to be disorderly conduct.
Any person violating the same shall be and is hereby declared to be
a disorderly person. Each day of any sale not in compliance with this
chapter shall be considered a separate violation.
Nonprofit organizations exempted from taxation under the provisions of the Internal Revenue Code shall be exempted from Subsections
B,
C,
G,
H and
I of §
130-3 of this chapter for the purpose of conducting public sales or auctions at property owned by such nonprofit organization(s).
