The Board shall have the following powers and
duties:
A. To hold as many meetings as, in the opinion of the
Chairman, or majority of the Board, are necessary or desirable for
the efficient discharge of the business of the Board. All members
of the Board present at any meeting shall sign the minutes of that
meeting.
B. To examine into the qualifications and fitness of
applicants for licenses and certificates.
C. To grant and issue certificates of competency and
special permits as provided in this chapter.
D. To suspend or revoke certificates of competency or
special permits when, in the discretion of the Board, after a hearing
upon due notice held, upon charges given to the holder of the certificate
or permit an opportunity to be heard in his defense in person and/or
by counsel, if the Board is satisfied that the holder of such certificate
or permit or any of his employees willfully, or by reason of incompetency,
has violated any provision of this chapter or of any other law or
building code applicable in the Village of Saugerties. In lieu of
suspending or revoking a certificate or permit, the Board may impose
a fine not exceeding $50 for the first offense, and not less than
$100 or more than $500 for any subsequent offense, and may suspend
the certificate or permit until such fine is paid.
E. To keep records of all meetings and proceedings and
of all certificates and permits issued, suspended or revoked by it
and to make such records available for public inspection.
F. To adopt such rules and regulations as may be necessary,
not inconsistent with the provisions of this chapter, with respect
to the form and content of applications for certificates and permits,
the reception thereof, the investigation and examination of applicants
and their qualifications, the conduct of the meetings and the business
of the Board, and the other matters incidental or appropriate to the
powers and duties of the Board as prescribed by this chapter and for
the proper administration and enforcement of the provisions of this
chapter, and to amend or repeal any of such rules and regulations,
by majority vote, at a special or regular meeting, upon notice of
at least 30 days to each member thereof.
G. To file a copy of all of its rules and regulations
and of all changes therein, duly certified by its secretary, with
the Village Clerk, immediately upon the adoption thereof, which copy
shall be available for public inspection during the regular business
hours of the day.
Any master plumber holding a master plumber's
license for a period of five years or longer in any other city, town
or village may, upon presentation of his license to the Village Clerk,
file for a special permit which will allow the holder of said license
to complete one plumbing job in the Village of Saugerties. He shall
pay a fee to the Village Clerk in an amount which shall be set from
time to time by resolution of the Village Board to obtain said special
permit.
Every registered plumber shall give immediate
notice of any change of address, and upon retirement from business
shall surrender his certificate of registry to the Plumbing Inspector.
All certificates of registration issued by the Board of Plumbing Examiners and all licenses or permits authorizing connections with street sewers shall expire on December 31 of the year in which they shall be issued and may be renewed within 30 days preceding such expiration upon the payment of a renewal fee which shall be set from time to time by resolution of the Village Board. The renewals will be for one year from the first day of January in each year. All licenses not renewed as provided above shall be defaulted and the person so defaulting shall apply for re-examination as provided in §
138-3; except that a person with a valid certificate of competency may apply for and receive an inactive certificate by paying a fee in an amount which shall be set from time to time by resolution of the Village Board. While in an inactive status, that person shall conduct no business nor do any act which requires a valid certificate of competency. That person shall be entitled to the reinstatement of his or her certificate of competency by the payment of a fee in an amount which shall be set from time to time by resolution of the Village Board.
Any plumber obtaining a permit to make connections
with a Village sewer shall save harmless the Village of Saugerties
from all suits, accidents and damages consequent thereupon for or
by reason of any opening in any street, alley or avenue made by him
or by those in his employment, for making any connection with a public
or private sewer or for any other purpose or object whatever, and
he will also replace and restore the street over such opening in as
good a state and condition as he found it, or reimburse the Village
for the cost of restoration when done by the Village; keep guards
by day and light by night, and keep and maintain the same in good
order to comply with all ordinances of the Board of Trustees applicable
thereto.
Every master plumber, before entering upon such business or calling, shall execute and file a bond in the office of the Village Clerk in the sum of $2,000 with one or more sureties which shall guarantee the master plumber's responsibilities under §
138-7.
All persons or corporations wishing to use the
water of the Village of Saugerties for any purpose or to make any
connection to any sanitary or stormwater sewer must first make application
to the Water/Wastewater Department, in writing, in the form prescribed,
upon blanks which will be furnished free of charge. Said blanks must
be signed by the owner of the property where the water is to be used
or for which the sewer connection is required, or by his or her duly
authorized agent, stating without reserve the various uses for which
the connection is required, and should the connection be required
for other purposes, after work is commenced or finished, notice in
writing must be given before the desired change is made, and an additional
permit granted.
It shall be the duty of the Plumbing Inspector
to see that connections to the water and sewer systems are properly
made and keep a record of all connections, noting the street and number
of the house so connected.
The Commissioners of the Water/Wastewater Department
will tap the main at a cost to the applicant which shall be determined
from time to time by resolution of the Village Board with corporation
cock furnished. No person or persons other than those appointed or
approved by the Water/Wastewater Department will be allowed to tap
the mains under penalty and no main will be tapped until application
is made and signed. A plumber receiving a permit to lay service or
supply pipes for the introduction of water to any premises shall give
the Superintendent of Water Works at least 24 hours' notice previous
to the time for tapping the main.
No cesspool or other system for sewage disposal
shall be constructed where a sewer is available, except by special
permission from the Board of Health, nor shall any connection from
such cesspool be made with any sewer.
The Village of Saugerties water supply and/or
any supply to be utilized for human consumption shall be distributed
through systems entirely independent of any industrial supply from
other sources or non-potable supply. Any connection between the Village
of Saugerties water supply and any private potable supply shall be
acceptable only if the Water/Wastewater Department agrees to accept
responsibility for supervision as provided in the regulations of Chapter
V of the New York State Sanitary Code.
Any person, persons, firm or corporation violating
any of the provisions of this chapter shall, upon conviction thereof,
be subject to a fine not to exceed $250 or imprisonment for a term
not to exceed 15 days, or both.
