The Town Board of the Town of Somers does hereby establish a commuter
exchange parking area in the following location subject to permissive referendum:
Somerstown Shopping Center.
The parking area is for the exclusive and nonassignable use of Somers
residents, who are permit holders, on a first-come-first-served basis.
Such use of parking facilities of the town shall be restricted as follows:
A. A parking permit must be obtained from the Town Clerk.
B. The permit is valid for one year, running from July 1
to June 30.
C. The fee for the permit shall be an amount set by resolution
of the Town Board.

D. Permits will only be issued upon proof of residency in
the Town of Somers.
E. The maximum number of permits issued each year is at
the discretion of the Town Board.
F. The Town Board may issue permits in excess of the maximum
number of parking spaces if it sees fit and has no obligation to provide additional
space should permit holders not find space available.
G. The granting of a parking permit by the town does not
guarantee to the permit holder that space will be available. Space will be
filled on a first-come-first-served basis each day.
H. Each permit granted shall bear the Seal of the Town of
Somers and shall contain the following information:
I. Any vehicles parked without a permit or in violation
of any applicable rule, regulation or section hereof shall be subject to being
towed away at the operator's expense, and such violation shall constitute
a traffic infraction within the meaning of § 1800 of the Vehicle
and Traffic Law, and any person violating any provision hereof shall be punishable
as therein provided.
J. The permit must be conspicuously displayed through the
front windshield.
K. The Town Police, the State Police or their agents are
authorized to have vehicles found without permits towed away.
L. The town is not obligated to provide security or protection
for vehicles parked in the parking area.
M. The Town of Somers is not liable for any damage or theft
of any vehicle, or property therein, parked in the parking area.
N. Prior to issuing the first permit, the town's liability
insurance must be expanded to cover this activity.
