Any person owning, possessing or harboring a snake, whether poisonous or nonpoisonous, who fails to exercise due care in safeguarding the public from bodily harm from said snake, has created a public nuisance and a threat to public safety. A person owning, possessing or harboring a snake shall be considered not exercising due care unless the snake appearing in public is properly caged to avoid bodily harm. Any person failing to properly cage a snake shall be in violation of this section and be subject to the penalties as outlined in §
124-18.
