The Town realizes and understands the importance of preservation and protection of the natural resources that enable its residents, property owners, and visitors to occupy and comfortably enjoy their stay within the Town. It is therefore established that, in order to preserve and protect the water supply that lies beneath our soils, the Town does hereby adopt and will enforce the following Wellhead Protection Plan of the Town of Warwick.
The Town, through its own forces and together with any and all agreements with contract personnel, and/or service providers, will inspect and operate all facilities related to water and wastewater, or that can impact water or wastewater, in a manner intended to prevent intentional or accidental contamination of any water supply, or potential water supply, in or adjacent to the community. This will include wherever possible, the actions of every department of the Town, including, but not limited to the Building Department, Fire Department, Department of Public Works, operators of the water and sewer systems, and contractors.
The Town will continue to encourage, adopt, promulgate, and enforce zoning and planning that enables the Town to protect its watershed areas by properly controlling development and uses in areas that have the potential to affect the quality of the water.
The various departments of the Town shall report all observed and potential spills and releases in the Town to the Town Supervisor as soon as possible and then to the Town Engineer,. so that the threat from contamination can be assessed and the appropriate measures to protect the water supply can be implemented. If the Town is responsible for the release, the Town will notify the New York State Spills Hotline and work with the New York State Department of Environmental Conservation to remediate the spill. Otherwise, the Town will cooperate with the New York State Department of Environmental Conservation to ensure that the natural resources of the Town are protected.
The Town will carefully consider the potential impacts prior to approval of any permits (including well permits to be issued pursuant to Chapter 160 herein), all plan approvals or uses according to 6 NYCRR Part 617, the State Environmental Quality Review (SEQR).
In regard to all existing and future wells for municipal or private water systems within the Town, the Town will require that:
Well sites will be protected from trespass and accidental tampering by maintaining locked fenced areas around wells.
The storage of salt, chemicals, petroleum products, paint, pesticides, or other materials that could potentially endanger a well will not be allowed in areas that drain toward any well, or within 200 feet of any well.
Future wells shall have a minimum two-hundred-foot radius of sanitary control from sewer lines and septic fields included in the planning and zoning for the project.
Storage of machinery shall not be allowed in areas that drain toward any well.
Parking will not be allowed in areas that drain directly toward any well.
Well sites and water collection, filtration, storage and distribution facilities shall be inspected regularly to assure that the components and areas surrounding all facilities are maintained in a manner consistent with the plan.
Area around any wellhead shall be maintained as a clear grassed area, stone, or gravel, sloping away from the well for a minimum distance of at least 20 feet in each direction. No paving containing leachable contaminates, such as semivolatile organic compounds in asphalt, shall be allowed within 50 feet of the wellhead.
Whenever wells are located in areas where vehicular traffic occurs and could jeopardize the wellhead, the wellhead shall be protected by concrete filled bollards erected on sides and in front of the wellhead.
Wells abandoned, or no longer in use, shall be sealed according to the standards set by the State of New York, in order to prevent potential contamination to waters within the aquifers.
