On and after the effective date of this Article,
no person shall raise, keep, harbor or maintain any chickens, roosters,
turkeys, pigeons or any other type or kind of fowl or birds, hereinafter
referred to as "fowl or birds," or rabbits, either as pets or as a
source of food supply, within the limits of the Village of Warwick.
Household birds, such as canaries, parakeets, parrots or similar household
birds, shall not be affected by this Article.
No owner, tenant or occupant of land within
the Village of Warwick shall permit such land or any part thereof,
or the buildings or structures thereon, to be used in whole or part
for the raising, keeping, harboring or maintaining of fowl or birds,
or rabbits.
On and after the effective date of this Article,
the following rules, regulations and restrictions shall be observed
and complied with by those persons presently raising, keeping, harboring
or maintaining fowl or birds, or rabbits, either as pets or as a source
of food supply, within the limits of the Village of Warwick:
A. The fowl or birds, or rabbits, shall be confined to
pens, cages or other types of enclosures, hereinafter referred to
as "enclosures," to which shall be affixed, attached or installed
thereon heavy-gauge poultry netting of one-inch mesh, with a one-inch
opening, at a height of not less than 12 inches.
B. Such fowl or birds, or rabbits, shall not be confined
in an enclosure within 10 feet from any property line.
C. Such enclosure shall be cleaned weekly with detergents
of such cleaning strength that will be effective in eliminating odors
that are or would be offensive to neighbors and the neighborhood.
Those persons presently raising, keeping, harboring
or maintaining fowl or birds, or rabbits, within the limits of the
Village of Warwick shall have 30 days after the effective date of
this Article in which to correct conditions that violate any or all
of the provisions of this Article that specifically apply to such
persons.
It shall be unlawful for any person to feed
any pigeons in the Village of Warwick, except those pigeons that are
kept by local citizens who feed them in their own pens and enclosures.
Any person committing an offense against any
provision of this Article shall be guilty of a violation punishable
by a fine not exceeding $250 or by imprisonment for a term not exceeding
15 days, or by both such fine and imprisonment. The continuation of
an offense against the provisions of this Article shall constitute,
for each day the offense is continued, a separate and distinct offense
hereunder.
