Any person disturbing the peace within Hilltown
Township shall be guilty of a violation of this chapter.
As used in this chapter, the following terms
shall have the meanings indicated:
DISTURBING THE PEACE
A.
Any act, word or conduct causing or tending
to cause a disturbance of the peace and good order of the Township;
or causing or tending to cause any danger, discomfort or annoyance
to any of the inhabitants of the Township or users of the Township
thoroughfares; or making any loud, boisterous or unseemly noise or
disturbance; or fighting or quarreling or inciting others to fight
or quarrel; or the public use of obscene or indecent language; or
the loafing or loitering or congregating upon any public streets or
alleys or public grounds of the Township of Hilltown, to the annoyance
of peaceable residents nearby or traveling upon any street or alley
or being lawfully upon any public grounds of the Township whereby
the public peace is broken or disturbed or the traveling public annoyed.
B.
The act of congregating or loitering on private
property by persons who are neither business invitees nor guests in
such a manner as to inconvenience other persons who are business invitees
or guests is also defined as “disturbing the peace” and
is hereby declared to be unlawful.
Any person who violates or permits a violation
of this chapter shall, upon conviction in a summary proceeding brought
before a District Justice under the Pennsylvania Rules of Criminal
Procedure, be guilty of a summary offense and shall be punishable
by a fine of not more than $1,000, plus costs of prosecution. In default
of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this chapter that is violated
shall also constitute a separate offense.
