The Kilbuck Township Code is hereby amended by providing for the establishment
of a Township budgetary reserve account.
The Township of Kilbuck does hereby create a budgetary reserve account.
The Township Treasurer is hereby directed to deposit all funds received
from the State Treasurer, pursuant to Act 77 of 1993, for the period of the
first calendar year in which the additional one-percent sales tax is in effect
into such budgetary reserve account.
The budgetary reserve account established by this article shall be maintained
by the Township of Kilbuck and the funds therein shall be retained by the
Township of Kilbuck until such time as the Kilbuck Township Board of Supervisors,
by resolution, shall direct its expenditure, whether total or partial, in
connection with any unanticipated fiscal emergency of the Township of Kilbuck.
An "unanticipated fiscal emergency" may be defined to include, but shall
not be limited to, any unbudgeted or underbudgeted expense relating to:
A. The construction or extension of public sewer lines to
serve residents within the Township;
B. The construction, repair or maintenance, including winter
maintenance and/or snow removal, of public roads within the Township of Kilbuck;
C. The purchase, lease, repair or maintenance of vehicles
or other equipment necessary to protect the public health, safety and welfare
of citizens and other persons within the Township of Kilbuck; and/or
D. Such other unanticipated fiscal emergency as may be defined
by the Board of Supervisors of the Township of Kilbuck in its resolution.
