It shall be unlawful for any person to:
A. Destroy, misuse, abuse, injure or remove any property,
trees, shrubs or plants in any parks, playgrounds, public open space areas
or floodplains.
B. Create a disturbance which constitutes a nuisance or
to disturb any wildlife or commit any act of nuisance in any park, playground,
public open space area or floodplain.
C. Throw, deposit or leave any litter or rubbish in any
parks, playgrounds, public open space areas or floodplains, except in authorized
receptacles.
D. Take any animal into any parks or playgrounds except
on a leash not longer than six feet or to permit any pet to go into any active
public play area, apparatus area, athletic field or recreational enclosure
or building unless said pet is participating in a program.
E. Discharge or have any firearms or fireworks except as
part of a fireworks display by the borough in any parks, playgrounds, public
open space areas or floodplains.
F. Possess any alcoholic beverages for purposes of sale,
consumption or free distribution in any parks, playgrounds, public open space
areas and floodplains, except that a permit may be issued by the Chief of
Police of the Borough of New Providence to a community-oriented organization
for a period of one day. Said permit shall be subject, however, to such rules
as the Chief of Police of the Borough of New Providence deems necessary to
preserve and protect the public welfare, and said use will at all times be
in compliance with existing state regulations relative to alcohol and its
sale, distribution and use.
G. Drive or park any motor vehicle or motorized bicycle
in any park, playground, public open space area or floodplain except on a
road or parking lot or an area especially designated for motor vehicles or
as otherwise permitted by the Chief of Police.
H. Be in any parks or playgrounds between dusk and 6:00
a.m. prevailing time, as such parks and playgrounds are declared to be closed
to public use during those hours, except upon approval of the Borough Council.
This restriction shall not apply to Centennial Park or Veterans Park.

The terms "parks, playgrounds, public open space areas and floodplains",
as used in §
191-1, shall include all public vacant land within
the limits of the Borough of New Providence which is open to the public and
shall include parking areas adjacent thereto.

Any person who violates any provision of this chapter shall, upon conviction
thereof, be punished by one or more of the following: by imprisonment in the
county jail or in any place provided by the municipalities for the detention
of prisoners for any term not exceeding 90 days; or by a fine not exceeding
$1,000; or by a period of community service not exceeding 90 days.
