The purpose of this Article is to eliminate traffic hazards which are
caused by the uncontrolled growth of brush, hedges or other plant life on
and along roadways located within the borough.
Within 30 days after receiving notice to that effect from the Chief
of Police or his representative, every owner or tenant of lands in the borough
shall keep all brush, hedges and other plant life growing within 10 feet of
any road and within 25 feet of the intersection of two roads cut to a height
of not more than two and one-half (2 1/2) feet.
The notice mentioned in §
225-9 shall be given in any case
where it shall be determined by the Chief of Police, after consultation with
the Chairman of the Public Safety Committee, that it is necessary and expedient
for the preservation of public safety to require the cutting of brush, hedges
or other plant life growing within 10 feet of any road or within 25 feet of
the intersection of two roads to a height of not more than two and one-half
(2 1/2) feet. The notice shall be served personally or by registered
or certified mail or, where there are buildings located upon the premises
affected, it may be attached to one of such buildings.
The cutting of such brush, hedges or other plant life shall be performed
under the direction of the Superintendent of Roads in cases where the owner
or tenant refuses or neglects to cut the plant life in the manner and within
the time provided for in the notice. In such cases, the Superintendent of
Roads or his designee may cut the brush, hedges or other plant life from the
lands. In the event, the Superintendent shall certify the cost thereof to
the governing body, which shall examine the certificate and, if found correct,
shall cause the cost, as shown thereon, to be charged against the lands. In
the event that such cost is deemed to be excessive, the governing body shall
cause only the reasonable cost thereof to be charged against the lands. The
amount so charged shall forthwith become a lien upon the lands and shall be
added to and become and form part of the taxes next to be assessed and levied
upon such land and shall bear interest at the same rate as other taxes and
shall be collected and enforced by the same officer and in tte same manner
as taxes.
