Editor's Note: This ordinance, in its amendment to § 125-16, Establishment of districts, excluded the R-2 Single-Family Detached Residential with Provision for Professional Offices District from the list of districts, and redesignated the provisions regarding the R-3 Multifamily Residential District, formerly designated as Art. VIII, as this Art. VII, which was formerly Art. VII, R-2 Single-Family Detached Residential with Provision for Professional Offices District, as amended 8-13-1991 by Ord. No. 7-91 and 12-10-1996 by Ord. No. 12-96.
A. 
The purpose of the R-3 Residential District shall be to create a zoning district for multifamily dwellings at a maximum density of 16 units per acre for all developments except housing for the elderly as permitted by § 125-26.
B. 
Within this zone, no lot or building shall be used and no building shall be erected or altered to be used, in whole or in part, unless it complies with the schedule of Article III and the following regulations.
Permitted uses:
A. 
Garden apartments;
B. 
Townhouses and row houses; and
C. 
Housing for the elderly in garden apartment, townhouse or mid-rise apartment buildings, subject to the following standards:
(1) 
All units in the development shall be reserved by deed or covenant for permanent residents of at least 62 years of age, except that the spouse or one immediate relative, live-in domestic, companion or nurse, aged 18 or older, may reside in the unit. In no event shall more than two permanent residents reside in any one residential unit designated as housing for the elderly. The deed or covenant reserving the unit as housing for the elderly shall be subject to the review and approval of the Borough Solicitor.
(2) 
The residential density of developments for housing for the elderly may be increased to a maximum of 20 units per acre.
(3) 
The maximum height of a mid-rise apartment constructed for housing for the elderly shall be 12 stories.
(4) 
The minimum unit floor areas in the R-3 Residential District may be reduced in accordance with the following schedule for units which qualify as housing for the elderly.

D. 
Day-care centers, community centers and recreation facilities designed and maintained to meet the social service needs of the residents within the development.
A. 
There shall be a minimum distance of 25 feet between any group of single-family attached units and any other group of single-family attached units. There shall be a minimum distance of 50 feet between any multifamily structure and any other structure or property line and minimum distance of 100 feet plus 10 feet for each story exceeding six stories for any mid-rise structure.
B. 
At least 20% of the gross usable site area shall be common open space as defined by this chapter. The use of this common open space shall be limited to active and passive recreation consistent with the preservation of natural vegetation and wildlife.
C. 
There shall be a minimum setback of 75 feet between any structure and a state, county or municipal street.
D. 
All streets, roads, access drives and parking areas shall be paved and provided with curbing in accordance with the Borough's standards and specifications.
E. 
Pedestrian walks shall be provided wherever normal pedestrian traffic will occur. Pedestrian walks shall be hard-surfaced in accordance with the Borough's specifications and standards.
F. 
All developments shall provide for landscaping, including shade trees, shrubs and lawns. The landscape plan shall be subject to the review and approval of the Planning Board.
G. 
All developments shall provide sufficient illumination of streets, roads, access drives, parking areas, dwelling entrances and pedestrian walks. The site lighting plan shall be subject to the review and approval of the Planning Board.
H. 
Each dwelling unit shall contain a minimum of one bedroom, complete kitchen facilities, interior storage areas, bathroom areas, adequate living space and a minimum habitable floor area, the measurements of which shall be submitted by floor plan with square footage measurements for each room and common area, which shall be attached to the application for inspection when filed by the Borough Clerk or in accordance with the following schedule:

I. 
All dwelling units shall be soundproof to at least a forty-five decibel limit.
J. 
Within each development, recreation areas for preschool children and school-age children shall be provided. Recreation areas for preschool children shall be fenced. Developments containing four or more acres shall be provided with open areas for active recreation and surfaced areas for court games, such as basketball, tennis, handball or volleyball. Developments containing 15 or more acres shall provide open field areas for group games such as softball, soccer or football.
K. 
No structure apart from such facilities contained within the dwelling structure or underground shall be permitted in multifamily developments.
L. 
There shall be a twenty-foot-wide landscaped buffer along the perimeter of the development.

Any construction, alteration, modification or change in the use of a building, structure or lot shall conform to the regulations in the Borough's Construction Code[1] and shall be subject to the review procedures in the Borough's Development Review and Land Use Procedures Ordinance.[2]
