It is hereby established in Pemberton Township a Historic Preservation Commission, which shall consist of five members and two alternates to be appointed by the Mayor for a term of four years. The Commission shall be comprised of one Class A member, one Class B member and three Class C members as provided by N.J.S.A. 40:55D-107, along with two alternate members. Class C members shall be residents of Pemberton Township and may not serve in an office, position or employment with the Township other than on a municipal land use board.
The Commission shall have the following responsibilities and duties:
A. 
The Commission shall have those duties and responsibilities as enumerated in N.J.S.A. 40:55D-109.
B. 
Additionally, the Commission may recommend to the Township or non-for-profit agencies operating within the Township the acquisition of historical artifacts or properties for safekeeping, preservation or public display.

Staggered terms. The initial term of the Class A member shall expire on December 31, 2024. The initial term of the Class B member shall expire on December 31, 2026. The first appointed Class C member shall have an initial term expiring December 31, 2024. The second appointed Class C member shall have an initial term expiring on December 31, 2025. The third appointed Class C member shall have an initial term expiring on December 31, 2026. The first alternate member shall have an initial term expiring December 31, 2024 while the second alternate member shall have an initial term expiring December 31, 2025. After each member or alternate's initial term, subsequent appointments shall be a term of four year from the expiration dates enumerated above.
B. 
Vacancies in the membership shall be filled in the same fashion as a member is appointed for the remainder of the unexpired term.
C. 
Annually, the Commission shall elect a Chair person, Vice Chair person and Secretary.
All members of the Historic Preservation Commission shall serve without compensation.
The Historic Preservation Commission may be appropriated funding in the annual budget of Pemberton Township at the discretion of the governing body. The Commission shall be authorized to receive appropriations from groups and individuals who desire to sponsor and maintain historic events, displays and programs for the residents of Pemberton Township.
The Historic Preservation Commission shall submit an annual report to the Township Council describing its activities, programs and expenditures conducted during the previous year, as well as its plans and proposals for the upcoming year. This annual report shall be submitted by March 1 of each year for the previous calendar year.
