The purpose of this article is to establish
a Municipal Alliance Council in accordance with the provisions of
N.J.S.A. 26:2BB-1 et seq., an specifically N.J.S.A. 26:2BB-9, which
authorizes the governing body of each municipality to appoint a "Municipal
Alliance Committee" which, in consultation with the Local Advisory
Committee on Alcoholism and Drug Abuse, is to identify alcoholism
and drug prevention, education and community needs. This Committee
is also required to implement the Alliance programs formulated pursuant
to the provisions of N.J.S.A. 26:BB-8. In addition, this Municipal
Alliance Committee is permitted to apply for funding in accordance
with the procedures established under regulations promulgated by the
Department of the Treasury found at N.J.A.C. 17:40-1.1 et seq.
There is hereby established the Pemberton Township
Municipal Alliance Committee which shall continue to operate under
the familiar name of "Pemberton Township Alliance Group" or its acronym
"TAG".
A.
Generally, pursuant to state law, the Township Council intends to include as broad a representation of the community as possible on the Municipal Alliance Committee. Thus, at least 50% of all members of the Alliance must reside with the Township of Pemberton except as otherwise provided in § 5-28B below; the members first appointed under this article shall be appointed for staggered terms, as follows: 1/3 shall serve one year, 1/3 shall serve two years and 1/3 shall serve three years. Thereafter, all members shall be appointed for terms of two years, unless otherwise specified below. There shall be no Board of Directors or Board of Trustees for the Alliance. Every member, whether appointed by the Township Council or who has volunteered for participation in the Alliance, shall be entitled to vote on issues affecting the Alliance. A complete list of Municipal Alliance Committee members, with their addresses, shall annually be provided to the Township Clerk; and each time a new member joins the organization, the organization shall supply that new member's name and address, as well as the commencement date of his or her term and the termination date of same.
B.
Municipal Alliance Membership appointed by the governing body. There shall be included on the Municipal Alliance Committee the following members, who shall be appointed by the governing body, by resolution, for terms as outlined in Subsection A above, except where the member's term is based upon his or her status as an elected or appointed official (i.e., Chief of Police or Superintendent of Schools), in which case that appointment shall be coextensive with that person's term of elected or appointed office.

President of the Board of Education.
(4)
Superintendent of Schools.
(5)
A Student Assistance Coordinator.
(6)
A representative of the Parent-Teacher Association.
(7)
A representative of the local bargaining unit for
teachers.
(8)
A representative of the Chamber of Commerce.
(9)
A representative from the Pemberton Township Municipal
Court system.
(10)
A representative of local civil associations.
(11)
Representatives of local religious groups.
(12)
Individuals who have been impacted by alcoholism and/or
drug abuse, including individuals who have been directly affected
by their own or family member's abuse or addictions.
(13)
Representatives of labor unions.
(14)
Representatives of the media.
(15)
Private citizens with interest or experience in issues
concerning alcohol and/or drug abuse.
(16)
Representatives of public and private organizations
involved in treatment of alcohol and drug related problems.
C.
In addition to the foregoing, the Township Council may also appoint other individuals, as at large representatives of the community, for terms outlined in § 5-28A above. These representatives shall be appointed by resolution.
D.
In addition to those members outlined in Subsections B and C above, individuals shall be free to volunteer their time and services on the Municipal Alliance Committee. Said individuals shall serve terms of one year each commencing with the date that they register with the organization and for a period of one year thereafter, which term may be renewed so long as they wish to continue to volunteer to serve the organization. There shall be no limit on the number of members who wish to volunteer under this category. Moreover, members who volunteer shall have all the same rights, duties and obligations as those members appointed under Subsections B and C above.
E.
Chairman of Alliance; organization; meetings. The
Township Council shall annually appoint a Chairperson and a Vice Chairperson
(to serve in the absence of Chairperson). The Chairperson shall sign
documents on behalf of the organization, establish agendas for meetings,
serve as the contact person for the organization with the Mayor and
Council, but shall generally have no other power or authority over
the membership. The members of the organization shall be free to appoint
a recording secretary, corresponding secretary and such other offices
as established under its bylaws. The Alliance shall hold meetings
regularly and shall establish an annual calendar of meetings at its
first meeting of the calendar year. Minutes shall be kept of all Alliance
meetings, and a quorum of Alliance members shall be required in order
for action to be taken. A quorum shall be 50% of the Committee membership
plus one.
F.
Bylaws. Bylaws shall be adopted by the Municipal Alliance
Committee and shall be subject to review and approval by the Township
Council. These Bylaws shall remain in effect unless and until otherwise
amended, which amendments shall also be subject to review and approval
by the Township Council.
The Municipal Alliance Committee shall undertake
to meet all of the responsibilities and perform all of the duties
and functions of municipal alliance committees established by state
statute and regulation. The Township Council specifically incorporates
herein by reference the provisions of N.J.A.C. 17:40-2.5 and 17:40-2.6,
and such other provisions of the state regulations which govern the
operation of municipal alliance committees created pursuant to the
authority of N.J.S.A. 26:2BB-1 et seq.
The Township Council recognizes that portions
of the funding made available to the Alliance are permitted to be
used as stipends for individuals performing necessary services on
behalf of the Alliance. Accordingly, the Alliance shall be permitted
to provide appropriations in its annual budget, subject to review
and approval by the Township Council, for stipends to be paid to individuals
for these services. The hiring of said individuals, however, shall
be subject to review and approval by the Mayor and Council. Stipends
shall be paid directly by the Alliance to the individuals, but said
individuals shall not be considered employees of the Township of Pemberton.
The Township shall annually enter into an agreement
with the County of Burlington for participation in the county alliance
programs. The Municipal Alliance Committee organized and established
herein shall implement said plan in accordance with the provisions
of N.J.S.A. 26:2BB-9 and N.J.A.C. 17:40-2.5(b). Moreover, the Alliance
may apply for funding through the procedures described at N.J.A.C.
17:40-1.1 et seq. The Township, however, is ultimately responsible
for these funds. Accordingly, the Alliance shall, as indicated above,
submit its annual budget to the Township Council for review and approval.
In addition, all funding received by the Alliance shall be reported
to the Chief Financial Officer, and all payments made by or on behalf
of the Alliance shall first be submitted to the Township Council in
the way of vouchers or purchase orders for review and approval. In
the event that the Alliance applies for grants, which are available
to it under various state programs, approval of the Township Council,
by motion or resolution, shall first be required before the funding
can be sought.
