The following requirements and/or stipulations
are set forth for residence in the Township of Pennsauken:
A. Residence in the Township of Pennsauken is required
for all new officials, applicants for employment and employees generally.

B. All employees who would become officials and all officials
who would become employees of the Township of Pennsauken hereinafter
are hereby required as a condition of their continued employment to
have their place of abode in the Township of Pennsauken to have bona
fide residence thereto except as otherwise provided by this chapter.
C. All officials and employees of the Township of Pennsauken
who are presently employed by the Township and presently maintain
a bona fide residence within the Township are also hereby required,
as a condition of their continued employment, to have a place of abode
in the Township and to have bona fide residence thereto, except as
otherwise provided by this chapter.
As used in this chapter, the following terms
shall have the meanings indicated:
BONA FIDE RESIDENT
A person having a permanent domicile within the Township
of Pennsauken and one which has not been adopted with the intention
of again taking up or claiming previous residence acquired outside
the Township of Pennsauken.
The Township Committee is hereby authorized
in its discretion, for good cause shown, to permit any officer or
employee of the Township to remain in the employ of the Township without
complying with the previous provisions hereof, where:
A. The officer or employee is exempted by regulation
or statute of the State of New Jersey.
B. The officer or employee is engaged in a professional
service. "Professional services" means services rendered or performed
by a person authorized by law to practice a recognized profession,
whose practice is regulated by law and the performance of which services
requires knowledge of an advanced type in a field of learning acquired
by a prolonged formal course of specialized instruction and study
as distinguished from general academic instruction or apprenticeship
and training. "Professional service" may also mean services rendered
in the performance of work that is original and creative in character
in a recognized field of artistic endeavor.
C. Notwithstanding any of the other provisions of this
chapter, the Township Committee of the Township of Pennsauken realizes
that there might be certain exigent circumstances where there are
certain skills which are necessary for the operation of the Township
of Pennsauken or any of its boards or autonomous entities, which are
not likely to be found among the residents of the Township of Pennsauken.
Accordingly, upon execution of an affidavit by the Chairperson of
the autonomous body or agency, or the department head of a department
of an agency of the Township of Pennsauken, or, with regard to the
Township of Pennsauken facilities itself, by the Township Administrator,
stating that good faith efforts had been exhausted to find a Pennsauken
resident who possesses the special talents and skills, the Township
Committee of the Township of Pennsauken may or may not, in its good
discretion, exempt, by resolution, said prospective employee who possesses
said special talents or skills.

Failure of any officer or employee to comply
with this chapter shall be cause for removal or discharge from service
with the Township of Pennsauken.

A. All candidates
for appointment to the title of police officer or fire fighter are
required to be a bona fide resident at the time of the closing date
following the announcement of examination and must maintain continuous
residency through the date of appointment to the respective title
in accordance with N.J.A.C. 4A:4-4.7(a)7.

B. Failure
to maintain a continuous residency from the time of the closing date
following the announcement of examination up to and including the
date of employment shall be grounds for removal of that candidate
from the resident portion of the Department of Personnel eligibility
list for appointment.

C. The provisions of §
74-7 shall not apply to the appointment of any individual to the title of Fire Chief as such title is described in New Jersey Department of Personnel Job Descriptions. This Subsection
C shall automatically expire and be void, unless extended by further action of the Township Committee, on December 31, 2008.

Certified copies of this chapter shall be forwarded
to the Director of Local Government Services and the Department of
Civil Service.
