As used in this chapter, the following terms shall have the meanings
indicated:
MOTOR-VEHICLE JUNK BUSINESS OR MOTOR-VEHICLE JUNKYARD
In addition to any general or special meaning assigned to it, shall
include and describe any business and/or any place of storage which displays
or any premises whereon there are displayed two or more unregistered used
motor vehicles or used parts of motor vehicles or material which has been
a part of a motor vehicle.

PERSON
As used herein, shall include individuals, copartnerships, firms,
associations or corporations. Masculine pronouns shall include either sex
and neuter gender, and words used in the singular shall include the plural.
Without having a license for such purpose from the Township Council
of the Township of River Vale, no person shall maintain, operate or conduct
or continue to maintain, operate or conduct, after the passage of this chapter:
A. Any motor-vehicle junk business or motor-vehicle junkyard.
B. Any business or place of storage for secondhand or used
motor vehicles.
C. Any yard, shop, store, storage lot or other place of
business from which he shall sell or offer or expose for sale, used parts
of motor vehicles or material which has been a part of a motor vehicle.
No person, licensed as provided in §
138-2 herein, shall continue to operate, maintain or conduct any such junk business or junkyard, or to operate, maintain or conduct any such yard, shop, store, storage lot or other place of business as specifically referred to in said section, after revocation or expiration of his license, as hereinafter provided.

Any person desiring a license under this chapter shall make written
application to the Township Council for a license to so operate, upon forms
provided by the Township, which application shall be accompanied by a license
fee of $500, which shall be returned to the applicant if the license is rejected
or refused, and retained by the Township if granted. Licenses shall expire
on June 30 of each year, and application for renewals must be submitted and
the annual license fee of $500 paid before May 15 in each year.
Each applicant for a license shall furnish such information as may be
required by the Township Council and his application shall be accompanied
by:
A. A letter from the Commissioner of Motor Vehicles of the
State of New Jersey, certifying that application has been made to him for
a certificate of recommendation under this chapter, and in his opinion the
license so sought for the operation of such business should be granted in
the public interest, which letter shall state the Commissioner's reasons
for such recommendation.
B. A letter signed by the Chief of Police and the Chief
of the Fire Department of the Township of River Vale, certifying that they
have examined the premises for which such license is sought and find that
the granting of the license so requested would be to the best interest of
the Township of River Vale, and that they deem the granting of such license
advisable, having regard to the depreciation of surrounding property, and
the health, safety and general welfare of the public. Said letter shall further
certify that the business so operated and conducted will constitute no fire
hazard and will not encourage or promote the violation of any law of this
state, particularly the statute relating to the sale of motor vehicles.
Upon the hearing of such application, the Township Council may, in its
discretion, issue or refuse to issue such license. Any license so issued,
shall continue in effect until July 1 next following the date of its issue,
unless revoked as herein provided.
In addition to the penalty provided herein for the violation of §
138-3, the Township Council may revoke any license granted hereunder for the violation by the holder thereof, of this or any other ordinance of the Township, or any state or federal statute, or for conducting or maintaining such business, or the premises from which the same is conducted, in a manner not conducive to the health, safety and general welfare of the public.
Any person violating any of the provisions of §
138-2 or
138-3 hereof shall be punishable as provided in Chapter
1, General Provisions, Article
I, §
1-14, in the discretion of the Judge before whom such conviction is had.
