[HISTORY: Adopted by the Mayor and Council of the Borough of Riverdale 11-1-1977 by Ord. No. 13-77. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
CHRISTMAS TREE
An evergreen tree used at Christmas for the purpose of being hung with gifts and/or decorated with ornaments.
COMMERCIAL SALE OF CHRISTMAS TREES
The sale to the public from outdoor lots of cut Christmas trees.
No person, firm or corporation shall be permitted to engage in the commercial sale of Christmas trees within the Borough of Riverdale between December 1 and December 25 of any year unless he shall have first filed an application for a permit therefor with and secured same from the Borough Clerk, which application shall be accompanied by an application fee in the sum of $10 and a bond in the sum of $200, cash or certified check.
It shall be a condition of the bond referred to in the preceding section that same shall be returned to the applicant if the premises upon which the sales are conducted by the applicant are cleaned and made free of leftover Christmas trees and debris not later than December 31 next. In the event that the Chief of Police of the Borough of Riverdale is not satisfied by that date that the aforementioned premises are properly cleaned, he shall be authorized to take whatever steps he deems necessary to restore same to its condition prior to said usage and to charge the expense of same to the aforementioned bond. Any sums remaining after all expenses are deducted shall be returned to the applicant.

Any person violating any of the provisions of this chapter shall be subject to a fine not exceeding $1,000 or imprisonment in the county jail for a term not exceeding 90 days in the discretion of the Municipal Judge before whom such conviction shall be had.
