A. 
This chapter supersedes Chapter 84, Subdivision of Land, of the 1985 Town Code, and prior enactments of the Subdivision Regulations which originally took effect on October 1, 1986. This chapter applies to all lands, buildings, properties, and their uses within the incorporated area of the Town of New Windsor.
B. 
This chapter is adopted pursuant to Article 66B of the Annotated Code of Maryland and Chapter 35, Planning Commission, of the Code. Any appeal or variance of the provisions of this chapter shall be in accordance with Chapter 35.
The purpose of this chapter is to:
A. 
Promote the health, safety, and the general welfare of the community by regulating and restricting:
(1) 
The height and size of buildings and other structures;
(2) 
The percentage of lot that may be occupied;
(3) 
The size of lots, yards, courts, and other open spaces; and
(4) 
The location and use of buildings, structures, and land for trade, industry, residence, and other purposes.
B. 
Minimize the potential for conflicts among the uses of land.
C. 
Provide for adequate light and air.
D. 
Prevent congestion and undue crowding of land.
E. 
Secure safety from fire, panic, and other danger.
F. 
Provide continuity and consistency with existing development.
The regulations set by this chapter shall be minimum regulations and shall apply uniformly to each class or kind of structure or land.
All new development shall be subject to the controls and priorities set forth herein. Lots currently improved or existing unimproved buildable lots shall remain subject to the setbacks and other requirements of the district in which they exist.
