The office of Borough Administrator is hereby
created for the Borough of Emerson, County of Bergen, State of New
Jersey.

The Borough Administrator shall be appointed
by the Mayor, with the advice and consent of the Council. Pursuant
to N.J.S.A. 40A:9-137, the term of office of the Borough Administrator
shall be at the pleasure of the governing body.
The Borough Administrator shall have, at a minimum,
a bachelor's degree in an appropriate field from an accredited college
or university, specializing in training for public administration,
with a master's degree preferred, and at least four years of responsible
experience in an executive or administrative position related to the
duties of said office. The Borough Administrator shall be chosen solely
on the basis of experience in or knowledge of accepted practice in
respect to the duties of that office as hereafter set forth.
The Borough Administrator shall receive such
compensation as may be fixed by ordinance.
During the extended absence or disability of
the Borough Administrator, the Mayor and Council may, by resolution,
appoint an officer or regular employee of the Borough to perform such
duties of the Borough Administrator. Such absence or disability shall
be limited to three months, after which time such absence or disability
may be deemed a vacancy by the Mayor and Council.

Pursuant to N.J.S.A. 40A:9-138, the Borough
Administrator may be removed by a two-thirds vote of the governing
body. The resolution of removal shall become effective three months
after its adoption by the governing body. The governing body may provide
that the resolution shall have immediate effect; provided, however,
that the governing body shall cause to be paid to the Administrator
forthwith any unpaid balance of his salary and his salary for the
next three calendar months following adoption of the resolution.
Any vacancy in the office shall be filled by
appointment of the Mayor with the advice and consent of the Council.
The Borough Administrator shall have the following
duties:
A. Devote full time to the interests of the Borough of
Emerson.
B. Attend all regular and special meetings of the Mayor
and Council unless previously excused.
C. Assist the Mayor and Council and CFO in the preparation
of the Borough's budget and administer the budget after its adoption
and implement the work programs contained in the budget.
D. Serve as the purchasing officer of the Borough and
administer a centralized purchasing system in accordance with the
provisions of governing statutes and sound purchasing practices.
E. Prescribe and enforce rules and regulations for the
efficient management of the Borough government, not inconsistent with
the ordinances and Borough Code and the State of New Jersey.
F. Coordinate the operation and administration of the
various departments, divisions, offices and agencies of the Borough
government.
G. Perform such other duties as the Code may require
or the Mayor and Council may otherwise prescribe.
H. Supervise all personnel of the Borough in conjunction
with the Mayor and Borough Council through the respective department
heads, unless otherwise provided for by law or by any other ordinance
of the Borough of Emerson.
I. Report to the Mayor and Council the monthly administrative
activities of the Borough.
J. Receive all complaints regarding services or personnel
in the Borough; investigate and dispose of all complaints, keeping
a written record of each complaint, the response made and action taken
with copies thereof to be provided to the Mayor and Council.
K. Inform the Mayor and Council as to state and federal
aid programs for which the Borough may qualify.
M. Oversee Borough insurances, including but not limited
to the Joint Insurance Fund, and other Borough programs.
N. Maintain appropriate channels of communication with
social and service organizations that affect the Borough.
O. The Borough Administrator and/or the Borough Clerk
shall be authorized to open bids received by the Borough in accordance
with law.
Nothing herein shall be construed to derogate
from or authorize the Borough Administrator to exercise the power
and duties of elected and appointed officials of the Borough.
