No police officer shall engage in outside employment without
the written consent of the Chief of Police.

A.
Outside
employment relating to the employment of Borough police officers for
services such as, but not limited to, emergency traffic control, traffic
management for site development, special event assignments for charitable
or public interest groups shall be permitted upon the deposit by the
prospective employer into escrow the sum of $150 times the number
of hours the police officer will be utilized at least five business
days in advance of the date on which police officers are to be employed
by the private employer.

B.
Consideration
will be given to any nonprofit organization in the Borough of Emerson
requiring police services for its effort to hold community fund-raisers
or sponsor community events. The fee per officer per hour will be
$50 plus the Borough administrative fee. The Borough has the option
of also charging an administrative fee based on the input of the Chief
of Police and the Borough Administrator. All officers regardless of
rank or seniority will receive the same $50 per hour rate of compensation.

The Borough shall be provided with an actual account of hours
worked, certified as true by both the private employer and the police
officer. The police officer shall be paid from the escrowed funds
at the prevailing senior patrol officer’s hourly overtime rate,
which will change yearly and follow the contract signed and authorized
between PBA 206 and the governing body[1], and other deductions shall be made as required for such
payroll disbursements in addition to such administrative costs as
are permitted by law and/or regulation.
All monies escrowed in excess of the costs and charges of the
services actually provided shall be returned to the private person
or entity within a reasonable period of time.
The Chief Financial Officer of the Borough shall establish a
dedicated by rider trust fund for the receipt of fees when police
officers perform outside employment services. The Chief Financial
Officer shall keep a separate ledger for each escrow established by
each individual employer and make specific notations as to the disbursements
and purpose thereof.
