This chapter adopts the 2009 Fire Prevention Code, as if more
fully set forth herein, for all new, nonresidential construction,
as well as commercial and residential existing structures, not regulated
by the UCC.
Nothing in this chapter or in the Fire Prevention Code hereby
adopted shall be construed to affect any suit or proceeding impending
in any court of competent jurisdiction, or any rights acquired, or
liability incurred, or any cause or causes of action acquired or existing;
nor shall any just or legal right or remedy of any character be lost,
impaired or affected by this chapter.
Persons who shall violate a provision of this chapter or shall
fail to comply with any of the requirements thereof or who shall erect,
install, alter, repair or do work in violation of the approved construction
documents or directive of the Fire Code Official, or of a permit or
certificate used under provisions of this chapter, shall be guilty
of a summary offense, punishable by a fine of not more than $1,000,
which conforms with the fine limits set forth in the UCC that ratified
the International Code Council and adopted the International Fire
Code, or by imprisonment not exceeding 30 days, or both such fine
and imprisonment. Each day that a violation continues after due notice
had been served shall be deemed a separate offense. The fines and
penalties may be collected by suit instituted in the name of the Municipality
of Monroeville before the District Magistrate in the like manner as
debts of like amounts may be sued for by existing laws.
In addition to the imposition of penalties herein described,
the Fire Code Official is authorized to institute appropriate action
to prevent unlawful construction or restrain, correct or abate a violation;
or to prevent illegal occupancy of a structure or premises; or to
stop an illegal act, conduct of business or occupancy of a structure
on or about any premises.
