It shall be unlawful for any person to discharge
any firearm, rifle, shotgun, pistol, air rifle, air pistol, spring
gun, spring pistol, BB gun, bow and arrow, paint ball gun, slingshot
or similar device or any implement that is not a firearm but which
impels a shot, bullet, ball or pellet of any kind with a force of
an explosion that can reasonably be expected to cause bodily harm
within or into the boundaries of Nether Providence Township except:
A. A police officer in the proper execution of his or
her duties;
B. A private citizen defending his or her life or property
as defined by Commonwealth of Pennsylvania Title 18.
C. A private citizen in the destruction of a suspected
rabid animal when the discharge of such firearm poses no danger to
the life or property of another.
D. An enrolled participant as part of an authorized or
sponsored school program.
E. A licensed and insured expert hunter for the purposes
of deer population management acting pursuant to a political subdivision
control permit issued to the Township by the Pennsylvania Game Commission,
conditioned on:
(1) Compliance by such hunter and the landowner of the
property on which the hunt shall occur with all terms of the political
subdivision control permit obtained by the Township from the Pennsylvania
Game Commission; and
(2) execution of an agreement by the landowner and hunter
agreeing to indemnify, defend and hold harmless the Township, its
officers, employees and public officials.
Any person or persons, associations or corporations violating any of the provisions of this article shall be punishable as provided in Chapter
1, General Provisions, Art.
II, Violations and Penalties, §
1-16, Building, health and safety violations.

It shall be unlawful and it is hereby prohibited
for any person, persons, firm or corporation to use, store, sell,
offer or expose for sale at retail or have in their possession with
intent to sell or with intent to use within the limits of the Township
of Nether Providence any air gun, air pistol, spring gun or any implement
not a firearm which impels with force a pellet of any kind. "At retail"
shall mean any sale of less than one dozen such articles or any sale
to anyone not a bona fide dealer therein.
The Police Department of the Township of Nether
Providence is hereby authorized to seize, remove and destroy any air
gun, air pistol, spring gun or any implement not a firearm which impels
with force a pellet of any kind which shall be used or discharged
within the Township of Nether Providence or which shall be held and
possessed in violation of this article.
Any person or persons, association or corporation violating any of the provisions of this article shall be punishable as provided in Chapter
1, General Provisions, Art.
II, Violations and Penalties, §
